    Kev dont worry i was a newbie at claiming back ppi and stuff. Now the fos had to deal with my loans with Welcome finance but Mine is close to being settled the fos has found in my favour and the settlement letter has been returned to the fos now its just a matter of time until Welcome finance pay me back. So dont worry and good luck you will be a winner im sure of that.

    Spoke to LLoyds they have received my letter of my compliant and I asked what the turn around is and its 8 weeks, so 7 more to go.

    Was just an inital call to make sure they have received my letter of complaint
    LLoyds TSB LOAN - Currently Stage 1
    LLoyds TSB CC - Currently Stage 1
    A&L Loan - Offer sent- accepted- awaiting feeback
    Capital One CC - Currently Refund £45.15 :p
    Halifax CC - Currently Stage 1
    AA Loan - Currently Stage 1

    Just checked with AA they also received there letter too.

    My A&L loan goes back to 2004
    AA was 2005
    LLoyds was in 2006

    A&L loan was 5k
    AA was 7k
    Lloyds was 12
    so thats a lot of cash back

    Is there anyway they can prove me wrong buy suggesting the PPI was not mis sold?

    They will try to do that anyway I am sure. If they were single premium up front PPI Policies meaning that effectively they were two loans one for the loan one for the PPI both with interest and added together as part of the loan. This is now seen as bad practice. Did they add the PPI without your permission. Did they tell you that it was compulsory or was it on a pre ticked box that you signed?

    The Onus is on them to prove they are correct. If after 8 weeks you do not get a satisfactory reply then you write again and tell them that you are taking them to the FOS.

    Hope that makes sense.

    Yeah loans were 2 based loans, one for the acutal loan and the other for PPI, which then came into a combined price

    They did ask permission but was rushed into it and pretty much told i needed it so i could take the loan, expecially when it comes to sick etc, to which i get full benefits from work so dont really need PPI.

    There was also a pre ticked box on the form, in fact the lloyds one wasnt even ticked just signed

    Then Kev I would say that you had a good case here. As long as you inform them of the reasons clearly and in your own words and how they can sort things out you should be fine. Good Luck and keep us informed

    What I said in the letter was


    This is due to the fact that I was not given the correct information when the policy was sold to me, as
    • your salesperson stated / implied that taking out the policy would assist my credit application.
    • your salesperson was very pushy in selling me the policy so that I felt I could not say no.
    • i am concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.
    • This is due to the fact that you have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests.
    • I was told that taking the PPI was the best thing to do as it covers when I am sick for work. I did advice i did not need this, as I receive full sick benefits from work.

    They sound like excellent reasons for a miss sale to me:D Fingers crossed on this

    Received a letter from Lloyds letting me know they are investiagting it and have said it may take a little time to have this issue resolved. By bare with them

    Ha they have 7 more weeks to give me a proper response and letter number 2 will be sent.
