Could maybe ring your OR and ask the question just to be on the safe side. Is the account still running?Dx

    Yet another question please guys

I went bankrupt last Wednesday, now my JSA was paid that day into my Bank Account ( I completly forgot this in the panic). After I called the DWP up I was told it has already gone in. Can I take this money from the account ( to live on only?)

I think it forms part of the estate so don't want to touch it if I don't have rights to it

OR interview next Wednesday so will know for sure then

    Hi Amiga,

Same things just happened to me, BR last Weds and DWP have just paid my final JSA payment into my old bank acc. Signed off a few weeks back, didnt think I was getting any more pay out so didnt inform them ! Im gonna wait till my OR interview next Weds (just heard its then) and ask if it can be used for living expenses? Desperate to get kids kitted out for school and that would of been so useful. But think its better not to access the account as it could put you in trouble. And I guess the OR could just claim it anyway.

    Hi Amiga,

I have had 2 payments of JSA paid into my old bank acc, only just found out about them.

I phoned the OR today and told him what had happened and I asked if I was allowed to access the money. He said that as long as the account hasnt been frozen by bank he was completely fine with me taking the money out for living expenses. I said I wasnt sure if bank had frozen account as I hadnt tried to use the cashpoint machine or gone into branch. He said as I was able to access account online then it definitely hadnt been frozen yet.

Found it a bit nerve wracking speaking to him but he was efficient and helpful.

That happened to me, also the HSBC  Anyway, I phoned them and explained that it was benefits money and the only money I had to feed my kids with. They agreed to let me withdraw the money if I went into my branch. Very humiliating experience that was as they were talking about me very loudly in front of other customers and cut my card up etc.

Might be worth a phone call to the bank...

slight update but I am confused

Had my OR interview, as predicted here she was nice but did ask an awful lot of questions. It was for around 45 minutes on the telephone.

Thing that confused me was she did say it gets refered to the Offical Receiver, is that not her? Also she went into the reasons a lot ( and dwelled on the Gambling a awful lot) Didn't say it outright but said that I may have to come in for another interview? Is that correct? Do people have more than just the one?

Am now a little worried about this as I thought today would be it. I mean she didn't yell at me or anything but I did build myself up to beleive after today I would be left to get on with things. As it is I am still in limbo a bit

Amiga, it was my interview today too. I too still have issue unresolved and need to speak to the OR. My interviewer today was not my official receiver but someone who called themselves an examiner.

I'm with you on the limbo x

It is a little odd isn't it MicheH?

Oh well nowt I can do about it now, she didn't even mention BRU to me and I KNOW I am getting one of those due to my conduct!

I guess I will find out in the next few weeks either way!

Thing that confused me was she did say it gets refered to the Offical Receiver, is that not her? No she is just the clerk or examiner who does all the footwork and puts everything together. They will then prepare a report and present it to the OR with their recommendations, the OR will then rubber stamp it if he agrees and then the clerk will come back to you. Also she went into the reasons a lot ( and dwelled on the Gambling a awful lot) Didn't say it outright but said that I may have to come in for another interview? Is that correct? Do people have more than just the one? If they suspect misconduct ie: gambling, then yes, to go through things again. This can happen any where up to 8 or 9 weeks before AD.

I am afraid you will just have to just get on with your life as best you can and try not let it get to you to much.
