I know this is a late reply. But to anyone reading this out there...PLEASE STAY AWAY FROM TUCAN CLAIMS. Their company is completely unprofessional. They un-lawfully deducted £249.99 from my fathers credit card, my father who is in his 70's and hasnt had any loans for the past 30 years!! They claimed to issued a refund and that was 3 months ago!!! please stay away!!! Im trying to do all i can to get my fathers refund back...0 -
In reply to the post's on this site i thought id tell you all about tucan claims and where your money is goin (you know the £249.99)
My mother in-law was contacted by them on the 4/11/2011 and the adviser asked for her and simply said would she like £1500.00 in her account for mis sold ppi, now for a old lady with very bad memory and gets confused a lot she give her details over not knowen what she was doin as the advisor said she needs the card details so they can process £1500.00 ppi refund, but neveer once told her about the £249.99 fee plus 10% (which u will also pay V.A.T on top 20%, so ull pay 30% in total)
Now contacted the bank and they said because she given her details out to them, sadly under visa rules she cant claim it back unless no paper work arrives (to which it did) so under tucans t&c we had a 14 day cooling off time so i cancelled with in the 14 days n yet tucan claims have so far to respond, but have sent my mother in-law a letter askin her to send back her completed claim pack, but here is best bit all communication has stopped from tucan and i can claim bk from the bank as any one who pays the £249.99p there payment goes to a international bank account and bank said under visa rules we are covered.
MY ADVICE TO ANY ONE OUT THERE IS TO SIMPLE LOOK FOR A PPI TEMPLATE AND DO IT UR SELF AND KEEP 100% BUT PLEASE PLEASE AVOID THIS COMPANY

First go here and report it as a fraud.
Then write to [EMAIL="info@claimsregulation.gov.uk"]info@claimsregulation.gov.uk[/EMAIL] and report that they have taken money before providing pre-contract information in writing and that they have failed to comply with repeated requests to return it.
Then go back to the credit card provider and tell them that the payment was taken "in breach of Regulation 11 of The Provision of Services Regulations 2009 (SI2009/2999)" and you therefore require full and immediate reimbursement in accordance with Section 75 of the Consumer Credit Act 1974 if they are unable to apply a chargeback.
This all needs to be in the name of the victim but it should resolve your problems.

Tucan claims have now responded, saying that they are "not refusing" me access to my aunt's data but it "would speed things up" if I sent them a full copy of the Power of Attorney I hold for her.
I've told them to apply to the Office of the Public Guardian to satisfy themselves that I can legally act on my aunt's behalf and if they are not prepared to do this I shall be making a formal complaint to the Information Commissioner's Office with regard to their breach of the Data Protection Act (1998).
I have recovered my aunt's £249.99, as they used a Danish bank account to take her money.0 -
Ive just had a very interesting conversation with The Financial Ombudsman. They say that Tucan Claims are doing what every credit card holder can do themselves. Yes, Credit Card companies are in this to make money out of us, and regularly increase credit limits without notice. Thats why I was tempted to go with Tucan, but glad I didnt. My experiance with CC companies is they increase your 'Limit' because your a good payer, or as one company said...quote:"we didnt want you to be embarrased if you couldnt pay for your goods!"-Rubbish.
I phoned and complained many times when the CC allowed me over my limit and then increased it....so as not to 'incur charges'. This is the CC companies blatently allowing the public to get further into debt! So you can see why Tucan are being successful at signing people up and extracting their cash! the Public are clutching at straws. ....Anyway, back to the Ombusdman. They say that they can act on the card holders behalf and submit a claim to the Credit Card Company, as they agreed, to allow you to get further into debt is wrong-especially without your consent. Its free and they do all the correspondence. If you have 'rquested' an increase in you credit limit- they can't help you. But as many like myself, found my limit increasing sometimes monthly its wrong. They have took on the case today, so Ill keep you posted..... :-)0 -

So, they saved you money in that case. The CC company cannot often stop you spending money. Moreso in the past when floor limits were higher and systems couldnt link in transactions in progress or even check your balance.This is the CC companies blatently allowing the public to get further into debt!

If you have just contacted the FOS front line staff then they tell you everything you want to hear. Its a common complaint about them. Once someone that does actually know what they are doing at the FOS looks at the complaint then its a different matter. I was at a meeting where we did some test calls to the FOS with issues that were not valid complaints but each was told it was something they would like to look at but you had to complain to the firm first but they would put the complaint in for us. I have also seen some of the complaints that have come via the FOS phone line and they are a mess.I am an Independent Financial Adviser (IFA). Tucan had their license from the MoJ suspended before Christmas. Unfortunately their appeal appears to have succeeded and as a result they are again active.
