    Thanks so much, I can adapt that letter no probs at all. I will have to send them cash as they cant take the money from my account as its part of my dmp. But the letter is perfect, I will keep you posted :)

  • Right guys - I really need some help! Please?

    I am sitting at my desk TOTALLY freaking out because I just phoned my OH who is at home this week (teacher) and he says that there is a Private and Confidential letter from RBS - this is in response to my Letter Before Action posted exactly 7 days ago. I don't want him to open it as I want to do it - so I don't know what the letter says.

    Now, I knew they were going to respond - of course. But I am sitting here shaking as I have never had any dealings with the courts before and I am so scared that this is all going to blow up in my face. As much as I read up about stuff (and I do research as part of my job, I'm not thick - honest!) - I still don't understand how the Scottish court system works and what might happen to me. Apart from amosworks, no-one seems very far down the line in terms of RBS so I'm really scared.

    Can anyone reassure me with an idea of what their bank (any bank) said in response to the LBA and if this is worth pursuing. I am so determined not to give up but not sure I can do this on my own. My OH is usually a great support but not convinced about all this claiming back stuff.

    Please don't tell my to post this on BAG forum as I always seem to get it wrong and get told off and could do with the lovely advice I get on MSE DFW board!

    MBNA = £4,000 / Next = £925 (approx. tbc on 19/8)
    Tesco = £2,910.11 / Smile overdraft = £500
    Bank of Scotland = £2,782.83

    (((hugs))) dear, sounds very worrying! You'll be ok though, remember you've got time to digest whatever's in their letter and decide how to respond. No need to feel pressured.

    I've got no advice about reclaiming charges specifically but I do know if you post here when you know what the letter says there'll be people to advise who know what they're talking about.

    When youve recieved the letter SS, GO BACK TO THE CONSUMER ACTION GROUP WITH IT if you have any queries. Theres a lot of inaccurate info being dished out on here and YES I AM A PEDANT!

    Thanks Lynz - sometimes I get scared as I always seem to get the posting thing wrong over there and seem to get told off a fair bit - will try that - thank you

    Today had an offer of a refund of £40 from a cc that we are trying to reclaim £130 from. Bit of a strange amount!

    On monday all my second letters are going off but so far have got back £15, been offered £60 and offered £40. Even if we get no more that's still £115- although I intend to get it all back!!

    I'll keep posting letting you know how I get on.

    Usually they offer around 50% but yours is just under a third so maybe there's no set rule?

    OOOOOOOOOOOoh am now slightly worried

    I've just posted off my first set of letters to Abbey regarding charges on current account and credit card.

    Just getting a bit anxious over what response if any I'll get. I've already tried calling and they refused to put me through to a supervisor.Have now got another £150 coming out in charges tomorrow!!!

    Will it never end?!
