    You can keep opening claims until the cows come home provided they are just. Let the banks know you are doing this and it's likely that they will just pay you everything in one go for simplicity's sake and to save them the hassle and costs. But don't be worried about anything though!

    CafCgirl, the advice from the BAG is DONT engage with conversation with them do it all in writing, then when it comes to court the evidence is there
    Dont want to sound like im nagging here ( sorry :) ) but there COULD be something said over the phone that impairs your ability to claim ( ie someone could say, I always knew you punished me for going over my OD) and this really could break the back of other claims for self & others.

    YES IM NAGGING I ADMIT IT!!

  • Right guys - I really need some help! Please?

    I am sitting at my desk TOTALLY freaking out because I just phoned my OH who is at home this week (teacher) and he says that there is a Private and Confidential letter from RBS - this is in response to my Letter Before Action posted exactly 7 days ago. I don't want him to open it as I want to do it - so I don't know what the letter says.

    Now, I knew they were going to respond - of course. But I am sitting here shaking as I have never had any dealings with the courts before and I am so scared that this is all going to blow up in my face. As much as I read up about stuff (and I do research as part of my job, I'm not thick - honest!) - I still don't understand how the Scottish court system works and what might happen to me. Apart from amosworks, no-one seems very far down the line in terms of RBS so I'm really scared.

    Can anyone reassure me with an idea of what their bank (any bank) said in response to the LBA and if this is worth pursuing. I am so determined not to give up but not sure I can do this on my own. My OH is usually a great support but not convinced about all this claiming back stuff.

    Please don't tell my to post this on BAG forum as I always seem to get it wrong and get told off and could do with the lovely advice I get on MSE DFW board!

    Okay - letter opened 5 mins ago and it is not so bad.

    Thank you for your recent query regarding charges on your account, which has been passed to our office for investivgation. In view of your comments, we have asked for a full briefing from those involved. Once this is received, a formal response will be sent to you. We will aim to get a response out to you as soon as we can but we also want to make sure that a thorough investivgation takes place. If, for any reason, there looks like being a delay, we will, of cours, write to you again to explain why.

    If you do have any queries in the meantime, please feel free to contact us.

    I've had a bit of a wierd letter from Alliance & Leicester, asking me to ring them to discuss.

    I plan on just sending second warning letter on Monday and not entering into a discussion.

    Any views?

    I had starting calling up about something else, to do with a letter about having been awarded a £300 overdraft, and had thought I had always had one so was a bit worried about that, and then I mentionned I had some questions about some charges which were going to be debited from account.

    I totally understood what was written about not engaging in case I trip myself up, but I couldn't actually see what they were for on my statement if that makes sense, but then he flatly refused to put me through, which I thought was very odd!

    Thats it now, all letters from now on just in case

    Dood it's 1998 FYI, just so you don't type the wrong year on your letter and look a numpty.

    I've started pursuing claims against 26 DCA's but I am damn hell not paying £10 for each one :eek: So I think I found a way to get the same information for 10%, ie for just £1.

    It won't work with normal banks accounts but anywhere you have a credit agreement, you can request a copy of this for a statutory fee of £1 under the Consumer Credit Act 1974. The request also extends to providing a statement of account and them not doing so is a criminal offense.

    I'll let you know how I get on as it might be a MSE spin on getting the same data :)

    Just an update. I had my last 6 years statements from Capital One today, plus a lot of other information. So need to sit down now and concentrate on it all. It looks as though there are approximately £300 of charges, some of which I may have asked back before, but should be able to ask for about £250. So here goes.....

    Bit of a result - I got £410 of charges refunded to my MBNA Card today - not bad as I only asked for £225 - I think they are getting really worried now!! I only sent 1 letter & less than 14 days later there the money was :) SO I'm going after A&L next! I used to work for them as well - so it'll be sweet revenge!

    Yep, dont phone them. Just looking for a way to trip you up. Proceed as normal.
