Hi
I'm about to try to help my sister to get back her bank charges. She's a single mum to 5 kids, 3 still living at home. Not sure how much bank charges we are looking at but I know she has been charge £210 this month and is set to be charged £290 next month. She only receives £500 a month in benefits so she is in a viciouse circle. I know ahe is not a very good money manager but with half her income every month going on charges she stand no chance.
Am I doing the right thing? I don't want to get her hopes up if she's not going to get at least some of the money back

First of all get over to the above mentioned website and spend a good lonf while going through all the FAQ's and other threads.
Then get her to open another basic bank ac with someone else and get her benefits paid into it so she can start with a 'clean slate'.
Then start the ball rolling with the first letter to the original bank asking for all statements and/or list of charges dating back the last 6 years enclosing a PO or cheque for £10 under the DPA - standard letter is on the BAG website.
Don't forget the cheque or they will write back somewhere along the line saying they can't send them to you without the money therefore delaying the process.Noli nothis permittere te terere

Hi everyone,

Have posted off my letter before action x 3 copies (1 to person to replied to me, 1 to branch and 1 to head office - just to be sure they got the message!) on Thursday 6th April.

how when you do scary things, your constipation suddenly clears itself, lol?????
Tonight I finally managed to log onto the moneyclaim website and put in a claim for hubby's account against Natwest.....all £2130 of it plus interest of course and I must admit my need for the toilet was increasing the further I was progressing into the form and was especially bad when I pressed the submit button!
I was a tad worried when I read about Amos going to court but was equally slightly cheered when I read about Natwest's offer.
So I guess here starts the 14 days start Monday or there abouts ....one quick question though.....does bank holidays form part of the time limit or are they excluded?2014 Target;
To overpay CC by £1,000.
Overpayment to date : £310
2nd Purse Challenge:
£15.88 saved to date0 -

Meh, the wrote to me the other day and offered an out-of-court settlement of 50%ish. Naturally I told them to go  themselves (in legalese of course). I know they won't go to court, no bank will. It will cost them so much to do it anyway, and they know they'll lose, so they will try every tactic in the book to stop you.
It's all mind games. The hard bit's done now mountainofdebt. Just sit back and forget about it! (Well not totally, check in on moneyclaim.gov.uk every few days for updates). You will see the status change from submitted to issued to acknowledged (if they reply and ask for more time to defend the case). After that they'll probably write to you, say they'll claim back charges if you complete the litigation (which they can't do anyway and they know it) and then pay you in full, maybe after making some offers. Just keep saying no until you get what you want, it's that easy. All mind games :-\
No need to say good luck, you certainly don't need any now0 -

Pixie, this is what my first letter said:Data Protection Act Disclosure Request
Dear Sir/Madam
Account Number; xx-xx-xx xxxxxxxx

Please supply me with a complete and exhaustive list of transactions and charges relating to the above current account, since xxxxx. Alternatively, a complete set of bank statements for that period would be acceptable.
I am aware that the information commissioner allows you to make a nominal charge for this service, and you may take this letter as my authority for you to deduct this sum from the above account, up to the legal maximum of £10.00.
Please be aware that this is a formal request under the Data Protection Act (1998). As you are no doubt aware, you are afforded 40 days to comply with this request or you must request an extension from the Information Commissioner. If you are of any doubt that this information is covered by the act, may I respectfully draw your attention to the case of Durant v FSA, where the judge ruled that bank statement information is indeed personal information and thus covered. In any event, this information is requested with a view to prospective legal action on my part and therefore would be covered under the same act.
I look forward to hearing back from you.
Yours faithfully
Got my statements within 4 days, and they didn't charge me anything for them
