  • Apart from amosworks, no-one seems very far down the line in terms of RBS so I'm really scared.

    If it's any help I started the small claims proceedings last week with Natwest - which are a part of RBS.

    Haven't heard anything as yet but there again I've been unable to get into the moneyclaim web site all week - I've forgotten the passeword and the new one isn't being sent to the email address that we used, D'oh!

    They 've logged it with their computer guys but that's no help to me as I would like to know what is going on ....having said that Natwest has until 29/04/06 to lodge a defence so I guess its not long to wait either way!!!

    Hi mountain (surprised to see you are still here now you are famous, being mentioned in Martin's blog! ha ha!)

    I am now due to submit my small claims court thingby but am in Scotland so its all a bit different. We can't use moneyclaim and there's not much advice on BAG about the Scottish system.

    Anyway, I can't afford it until Thursday when I get paid - then I've got to worry about how to get out of work early to get to the court (an hours travel away from work) to submit the claim (I don't think we can do it online).

    I'm really scared but DETERMINED not to drop this and be scared off.

    P.S. Lynz in Scotland its £37 for me - that probably doesn't help though, but I'm only claiming for £750 (all you can claim for in Scotland) so I don't know if that's why its relatively low

    MBNA = £4,000 / Next = £925 (approx. tbc on 19/8)
    Tesco = £2,910.11 / Smile overdraft = £500
    Bank of Scotland = £2,782.83

    Lynz, it will depend on the amount you are filing for. If you have a look on the Moneyclaim website, there is a link to a court type site where there will be the cost increments. I can't find it now (typical!) but it should be there. I'm hoping we get offered a partial refund from one of the banks to help pay for it all! If not, we will find the money. Not entirely sure how, but I should have some coming to me in July (holiday money, but hell, this is important!).

    Im claiming £615 and the court costs were £80 whether I did it through moneyclaim or direct at the county court. I decided to do it direct with the county court because you are limited to the amount of words and lines that you can put on the money claim website to justify your claim. It can be done on the money claim website but I understood the wording on the hard copy claim better and thought that if I do end up going to court that I need to understand what I am talking about :o I filed mine on Wednesday but havent had anything back yet

    My claim was for over £2.5k, and the court cost itself was £120, which is the maximum for the small claims court. As the others have said, it depends on how much you are claiming.

    Just found this info on the HMCS website -
    up to £300 £30
    £300.01 - £500 £50
    £500.01 - £1,000 £80
    £1,000.01 - £5,000 £120

    I paid £120 in costs to start reclaiming my £2,700. However, whatever the court fee is gets automatically added on to your total after what you're claiming, any added interest, and your legal costs.

    Amos, is it the case then that I have to pay this 120 upfront? ie now?
