I had a reply back from the Halifax today after they received my preliminary letter. They sent me a stanard "sorry to hear your not happy" response with a leaflet about customer complaints...said they would investigate and get back to me in no more than four weeks

I'm assuming I just move on to the next step of sending my letter before action???

    Thanks, DD

    Hi Guys

being a new girl I don't understand this 100% - I bank with Nationwide, a basic Flex account. They charge us between £25 and £32 per bounced DD. There are no overdraft fee's as we don't have one. Even if something bounces and it's my fault - insufficient funds etc can I still claim back the fees? When they charge us, they wiat for the salaries to go in, take their charges and then the train of tigger bouncing and charges starts again. It's another cost that we can do without and one we certainly don't budget for. Please advise.

    Thank guys

don't suppose anybody has an answer to this one, i know somebody in a similar position who wants me to help them claim their charges back. Most are over unagreed overdraft charges at £20 a month etc.

Just been thinking more about this, and wondering if I could claim for my cards as well. Hubby and I have had charges recently on capital one and monument cards for late payments, and 4 years ago I incurred lots on a lloys tsb credit card, but that defaulted. can you claim charges on a defaulted and closed account?

In my opinion, when the 14 days are up that you gave them go onto the next stage. You set the time limits - they are just try to stall but check this advice first on the CAG website. All the best :)

Apols if this has already been covered (just point me in the right direction), but....

I've done all the first and second letter bits to our bank/credit card co and was all set about to file claim when I read somewhere that all bank charge claims were being put on hold until one particular case is settled.

    Is this the case?

Am I better off holding onto my claim fee for now or should I file anyway?

If I hold back, should I write to the banks concerned and say that I was all primed to do so until I heard about x case but intend to continue the claim as soon as that issue is resolved?

What am I best off doing? Between my partner and I there is almost £3000, all of which, aside from measely goodwill gestures which I have turned down, is being refuted. £3000 is too much to let go if it is rightfully ours. I don't want to lose out.

Some were put on hold but then the test case collapsed when the bank settled out of court - that just shows how confident they are!!! I'd say go right ahead and good luck!!!

    Hi,

Can anyone tell me if I am legally entitled to word my claim to the small claims track worded like this?

"The Pursuer claims from the defender the refund of £356 in charges, plus the cancellation and/or refund of any additional penalty charges that may be applied to the pursuers account whilst these proceedings are ongoing.

The Pursuer also claims the expenses of bringing this action to court."

I am worried I can't ask for charges not yet added to the account. (Monument Credit Card)

    Cheers
