Prompted to post for the first time today as I received a response to my preliminary letter to Halifax…
I have also written letters for Grumpy (OH), so between us both the story so far is…
Halifax (I have combined the charges for my own account and our old joint account in one claim) – Total for both accounts - £2971
Preliminary letter sent – 14th July.
Today (18th July) I received two letters (one for each account) offering a total of £354 as a gesture of goodwill!
Goodwill? Shabbywill, I’d call it! About 12%.
I sent an amended LBA, acknowledging their gesture but stating that I wanted a full repayment. I don’t know if I should have said, “but you can throw the measly amount in my account in the meantime” – I hope they will think I am serious if I don’t look too keen to grab the first scrap they throw down.
Anyway, a bit scared now, all the same! Particularly, as their response stated that they reserve the right to close my account if I don’t manage it correctly.
Have also gone through other accounts for Grumpy and I (I’m afraid I am so anally retentive that I have statements going back to the year dot) and am also claiming the following…
MBNA - £150 claimed – Preliminary letter sent – 28th July – not a huge amount, I know, but it’s got to be done.
First Direct - £330 claimed – Preliminary letter sent – 28th July.
MBNA (Grumpy’s) – £275 claimed - Preliminary letter sent – 28th July.
Hope I’ve done the right thing!!!!

Just an update...just filed my Moneyclaim (coz I got paid & could pay the fee
) against Natwest....just over £3k with interest & charges....keep evrything crossed for me!

Just recieved all my statements but only for 4 years, the total is £1141.00 sent the letter off. this is with natwest has anyone got any storys about this bank?0

My Nephew has just contacted Monument with a DPA and received a response telling him that he owes over £900 and that they have sold the debt to Cabot Collections. He phoned Cabot who said they bought the debt in good faith and are going to continue to add interest to it. He tried to get them to scrub the £471 of charges and he would then pay the actual debt he owed. This has become a bit of a mess. Any advice on what to do about this would be appreciated.

That's so good to hear! I have just sorted out my loan with HSBC so that they can't demand immediate payment, and now I want to start to claim my charges back.
SS, am I right that in Scotland you can only claim up to £750, for the past 5 years? Where can I find out more about the Scottish rules?
Also, when you send them the letter (I've found the template on the Consumer Action Group Website) what charges are you allowed to claim for? Presumably not overdraft interest, but everything else?
Any advice gratefully received!

Jaggiethistle, As far as I can work out you can claim £750 per action. This does not mean that you cannot raise more than 1 action against them. eg, if you have £1500 in returns, take out two actions. Just split the charges against you into two seperate claims, (I would do this by dates, ie first 3 years, last 2 years).
Do read the CAG website thoroughly though. It does take a bit of getting through, but it should be worth it in the long run.

Take a look at https://www.govanlc.com, it has all the Scottish info you need.
Your right about the £750 and 5 years. If your charges are made up of different things, like say some are for overdraft and some for returned DDs/cheques, then put in separate claims on the same account for the different sets of charges. That way you can effectively claim back more that £750. Of course you will need to pay for more than one summons, but you will get that back.0 -
I have finally just received payment for settlement of just shy of £2000 from Abbey. Even at the last minute they like to keep you hanging on, they deposited the refund via cheque from themselves which still takes 3-5 days to clear - LOL!
I'm happy tho! Go for it all0 -

I hope not as thats the point I'm at now, I have about 8 days left before I need to file my claim
I'm suprised the banks are letting it go this far if they know that they will have to add on my interest (which is going to be over 500 itself)
has anybody else had success with Halifax lately as I've not read and sucess stories for a while??? getting a bit worried I guess :embarasse0
