    I think I'll wait until somebody can clarify before I send it, really don't want to make a mistake as I could really do with this money to clear my credit card debt

    Have a read here mate! They advise you to send it but don't include the 8% interest! :)

    I'm confused now, lol

    this is the letter I am planning to send and was going to attach a spreadsheet detailing the charge dates and ammounts and interest..

    Dear Sir/Madam

    Account no: (your account number)

    Over the past six years, you have charged me for (enter what they have charged you for, e.g. exceeding your credit limit). It has come to my attention that this is unlawful at common law, and under statute and recent consumer regulations.

    In the terms of the contract which you agreed to at the time that I opened my account, it is implied that you will conduct yourselves in a manner which complies with UK law.

    I require full repayment of these charges, which I calculate at £xxxx plus interest of £xxxx. The total is xxxx. I also ask you to remove any default notices on my credit record that are related to these charges. A correction or amendment to the entries are not acceptable.

    If you do not comply fully within 14 days, I shall begin a claim against you for the full amount, plus interest and costs, plus a claim under ss.7 and 13 of the Data Protection Act 1998.

    Furthermore, I shall submit to the OFT a complaint under the Consumer Credit Act 1974 upon the basis that you have failed to comply with their direction of 5 April 2006 and are therefore not 'fit and proper' to hold a consumer credit licence under the 1974 Act.

    the only correspondence I have had with the bank so far was requesting my six year bank statements..

    I left that out coz it got too confusing and I couldn't work it out.

    The other interest is the 8% one that you can claim back only when it's gone to court. If your talking about the same spreadsheet as me (the 8%) one it calculates how many days since you were charged that amount!

    Does that make sense? :confused: Think I've confused myself! :rotfl:

    No thats alright.

    If you want to claim back the interest you got charged while over your OD coz of the charges then work that out and include that. I couldn't work it out though so left it out! :rotfl:

    Hi

    I've been reading about DFW's claiming back their bank charges, and wondered if i have a small claim?

    Nationwide charged me £15 last year for paying less than the minimum amount off my credit card, this was about £2 less than it should have been and a mistake on my part. Has anyone else claimed for a small amount and is this even claimable?

    I see on the consumer action group that NW are closing banking accounts of those who claim presume this is for large amounts? They wouldn't do it for £15 would they :confused:

    I've sent my prelim letter to NatWest & had the "go away" reply, so I've posted my LBA & schedule today - only for £2311.86, including the overdraft interest!

    Am waiting for Capital One to reply to my prelim letter for £240.....

    Will keep you posted!

    Got a refund of £1050.50 from HSBC last week - after 2 letters and without even filing a claim. Do it today - it's easier than you think!

    Total Debt: Owe about £19,000 on credit cards plus £24,000 which is my half of joint loans.

    I think if all this keeps up they're going to have to open a whole department to process these claims! :T

    How soon before they cotton on and just refund everyone they haven't and reduce or illiminate charges? Never probably.
