    Hi Pixie, & Well Done, you must be over the moon. How long did this take to happen from the time you put your court claim in? And good luck on case #2

    All within one week! I recieved a letter from them saying they were going to defend my claim and then three days later I got the letter confirming they are returning my money :)

    I called them on Wednesday regards to getting the money by cheque and m still waiting to hear back from them.

    Ok, so it must be the Acknowledgment of Service then. They have 28 days to enter a defence from the date on the AoS. Nothing you can do except prepare yourself. If you haven't read Patricia Pearl's book on small claims procedure, now would be a good time, while you wait! ;)

    Received letter from Halifax this morning, following my letter before action. They have told me that following my refusal of their first two goodwill gestures (£95.00 and £280.00) they are not prepared to refund my charges, and suggest I make complaint to the Ombudsmen Service.

    Its now time to follow through my threat of court action with them. Should I do this straight away. They still have 4 days before the end of the 14 day deadline so do I have to wait until then?

    Lthough I am determined to go through with it, now crunch time is here I am getting a little nervous. People around me keep telling me no chance and they will stand up in court and defend blah blah. I know from the responses on here so far that the odds are in my favour, but I am now going into unknown territory and its a little scary.

    Go for it. They have clearly told you to sod off, so no point in delaying further, you have made every attempt to mitigate and keep it out of the court system.

    People around you don't know what they're talking about, I do. WE do. If you haven't been to CAG yet, click on my sig and have a read. As of last week, over 1 MILLION pounds refunded in unlawful bank charges!!!
    And just think, when you get your money back, how FANTASTIC it's going to be the one going "Told you so, told you so!!!" :D to the doubting minnies!

    I called the Halifax again today and said that although I had recieved a letter from the court which I needed to return to confirm if the claim was now settled, I wasnt prepared to sign it and return it unless they gave me access to MY money and that they couldnt dictate what happened with my money. So they lifted the block on my internet banking account and Ive arranged for my money to be transferred to my new bank account :T As soon as it hits my account I will sign and return the form to the courts :beer:

    Im sending it to the cccs so they can distribute it fairly between my creditors, i know if i'd have left it in that account one debt would be completely cleared but i didnt think that was the fair thing to do.

    Hi guys
    Had a threatening letter back basically saying 'we will not refund, go ahead and try claiming and we will close your accounts'.
    I have another account with a different bank, so am not concerned about them carrying out their threat. But still nervous and confused.
    When i fill in the on-line court claim form, do i put the total they owe me, or do i include the 8% as well? Do i just add 8%, or is there a calculation to do?
    Worried i will make a mistake.

    :j I had a letter refunding my charges in full but not my interest yesterday from capital one and this was just after my prelim letter was sent - I had just sent my LBA but letters must have crossed in the post:beer:

    Just a very quick post....

    Filed my claim against Lloyds TSB in Feb 2006, following the advice from The Bank Action Group. Claim was submitted to Moneyclaim, and subsequently defended by the bank.

    Began to feel that I'd started something I really shouldn't have - and got very close to giving in - which I suspect is exactly what they hoped I would do. However I did not and today I received a letter to say that they want to settle my claim - without admitting that I am in the right - but that it would be too costly to defend.

    YIPPEE - thanks to eveyone for their support, and hooray - my 'sig' will look even more healthy once the payment hits my account!!!

    Anyone contemplating taking this path - read the FAQ's on the Bank Action Group forum - FOLLOW them to the letter, and Good Luck.
