Got a letter today following the prelim letter offering £168 when i am claiming £360 - not sure what to do now shall I pursue the extra or just accept this - the account withthem is closed they said they will reduce their charges to £12 so in effectthey are giving me back £8 per charge - this is from capital one - anyone else claimed from them? I have posted the same on CAG forums

Yeah I got £180 back from Cap One which was the full amount I was requesting. This was about 4 or 5 weeks ago. Sainsburys have agreed to give me back the charges they applied to my account too.

    It's all groovy!

Ever wonder about those people who spend £2 apiece on those little bottles of Evian water? Try spelling Evian backward.
  • That's great! I'm waiting to hear details of charges from Cap one - glad to hear they are paying out!! Did you have to wait ages for the information or were you organised enought o have it already?

Got a letter form Barclay Card this morning saying they were reducing their charges for overlimit and late payments to £12. They also said they were increasing the interest rate charged on the balance to over 2% per month.

Looks like they are beginning to change the way they raise their profits now.

£12 is still too much though.

Apologies if this is a repeated question but bouncing a baby on my knee and typing whilst trying to read and type is not easy but I used to get heaps of charges fromm Abbey when I was with them over 2 years ago. Have since gone on to a debt management programme with Payplan so it raises a few questions.
    1. If I ask them for bank statements which they will charge for how far back can I go for my claim to have a legal chance of winning and is there a maximum amount of years that they have to keep these?
    2. They currently are accepting my payment back via Payplan. If I then try and get the charges back can they cancel the acceptance with Payplan and force it throught the courts?
    3. Will the fact that the account was closed make any difference to a claim.

fingers crossed they above will be answered in my favour but if not can claim back the charges with Nationwide who I am with at the same time.lol

Also......is it still 6 years you can claim? And am I right in reading that you can claim back your late charges, etc with credit card companies?

Sorry yet more questions, the letter that I need to send for my 6 years worth of statements is in the BAG library but where is that? does anybody have a link as having an incredibly deumb moment but I can blame it on bouncing the baby on my knee syndrome!

Try and do it when the littleuns in bed, some of it is quite complicated, you are suing the bank.

When you say they have entered a defence, do you mean they said they would defend (on the Acknowldgemnt of service) or did you actually receive a defence? If the latter, it should have been sent by the courts at the same time as the Allocation Questionnaire and with a deadline for you to fill in the AQ. If the former, you'll have to wait for that to arrive. They have 28 days from the AoS to file a defence or you win by default.
