    Hello, I am claiming back from the RBS. I sent them a letter asking for details of my charges and got that.
    I sent them a letter saying that I was giving them two weeks and then if they didn't respond I would give them another letter two weeks before taking court action. (these are the letters from Consumer Action Group forum)
    Two weeks has elapsed. I received information regarding my account as requested. I got a phone call yesterday saying that when head office gets the same information (due to an error at the branch they don't have it yet) they will get back to me with a response.
    My question is should i send the second letter giving them two weeks before I take court action or should I wait for their response in case it is a friendly offer?
    Advice gratefully received as I have joined the BAnk Action Group but am unable to post there.

  • hi, just thought i would let you know my progress. 8th June i phoned halifax plc and asked for all statements on all accounts going back 6 years. 15th June sent first letter to halifax asking for £508 charges back plus interest, tol dthem to reply within 14 days or would start legal action. 20th June had letter back saying they would look into it and i should hear something within 4 weeks. 27th June received letter from halifax offering me a gesture payment of £125 in full and final settlement of my claim.

    now, if they knew that by going to court they wouldnt have to pay me anything, why are they offering £125 lol. A letter will be going out tomorrow saying i do not accept and i will be taking them to court in 7 days if my charges are not returned to me. Wish me luck this is scarry business.

    What do you do if you don't get a reponse to your DPA request? We sent it on 24th May then on 1st June they said the account couldn't be traced. The info they requested was sent 4th June but there has been no reply from them. Should we chase this up with another letter? If they don't reply what do we do?
    I have been on CAG but am quite confused. Thanks in advance,

    2nd letter. If they were to make you a friendly offer (yeah, right), sending the 2nd letter wouldn't jeopardise that. If they don't, then you're still on your timetable, not theirs.

    Why can't you post on BAG? Is there a problem? PM me the details, pls, and I'll look into it for you.

    Barclaycard are a pain in the backside, and they hold out as long as they can in the hope you will go away quietly. But like all the others, they pay. It just takes longer!

    The correct term is a Subject Access Request under the Data Protection Act 1998. A bit of a mouthful, so shortened to DPA (Well, I say SAR, but that's me).

    Give them a call, remind them the clock is ticking, it sometimes produces results when they're prodded.

    Thanks, I am trying to reclaim them for my Dad, I can't see him phoning so it will need to be a letter.
