Hello everyone,
**Please note, I was claiming in Scotland and court system is a bit different than in England**
Well its been a fair journey but I DID IT! Yay me and thank you guys so much for all your help and support!
After my return day passed without RBS entering a defense last Tuesday morning - about 11am my mobile phone rings and its Mark, a lawyer from RBS:-
Mark@RBS: "We understand you are having some problems with customer service and issues of charges from Royal Bank of Scotland"
Me: "Yes" (sitting at Perth train station, caught unawares!)
Mark@RBS: "We'd like to settle the matter by offering you a full refund of £743 + £39 court fee - only if you agree to keep this a secret" (Ha! Try and stop me!)
Me: "Okay - but what about the 8% interest" (Jumping up and down!)
Then follows a boring conversation where he ensures me he doesn't understand the 8% interest thing (yeah right, you have a law degree!) and he assures me it only adds up to £4.95 anyway. We argue back and forth for a while.
Me: "I think you'll find its about another £100 on top of the £782 you already are repaying to me"
Mark@RBS: "I'll need to calculate it and ring you back"
Call No. 2
Mark@RBS: "Well thank you for that thankless task" (Talking about calculating the interest - and yes, those were his actual words)
"You are due £884.62" which includes £102.62 of interest"
Me: "Thank you and when will I see this money"
Mark@RBS: "It'll be paid into your account today"
It appeared in my account on Thursday! And for the first time in 8 years, my bank account was in credit and due to stay that way for the future!
My overdraft was £850 so I just paid this all off, paid a little bit off the Barclaycard and had a bottle of cheap plonk!
For anyone who is considering reclaiming bank charges - go for it! PM me if you need any help (particularly in Scotland) or are claiming against RBS.
I have filled in the CAG survey - but its really geared (in the stages bit) towards people who have claimed in England so my answers were a bit skewed - but its filled in all the same!

Trying to help SIL out with her Woolwich bank charges. The Woolwich has said they will charge £5 per statement and they are calling her today. Does anyone know the actual legal term she can quote to get all her statements for the past 6years paying just the £10.
Can someone post a link? Im disabled and head is abit squiff today, so the thicker described the better.
The woolwich are being right pains. What does she tell them when they call her?

Data Protection Act Disclosure Request
Dear Sir/Madam
Account Number; xx-xx-xx xxxxxxxx
Please supply me with a complete and exhaustive list of transactions and charges relating to the above current account, since xxxxx. Alternatively, a complete set of bank statements for that period would be acceptable.
I am aware that the information commissioner allows you to make a nominal charge for this service, and you may take this letter as my authority for you to deduct this sum from the above account, up to the legal maximum of £10.00.
Please be aware that this is a formal request under the Data Protection Act (1998). As you are no doubt aware, you are afforded 40 days to comply with this request or you must request an extension from the Information Commissioner. If you are of any doubt that this information is covered by the act, may I respectfully draw your attention to the case of Durant v FSA, where the judge ruled that bank statement information is indeed personal information and thus covered. In any event, this information is requested with a view to prospective legal action on my part and therefore would be covered under the same act.
I look forward to hearing back from you.

Lloyds tsb have entrered a defence. They did this a couple of weeks ago- what happens next? Do I have to do anything or do I have to sit tight and wait for the cheque

I think you need to correspond in writing with the woolwich, their customer services probably dont deal with the data protection act too frequently so will not be fully trained in it. If you send the above letter that will be the best way.
Also it is worth noting that the 40 days starts when they recieve the £10 payment, whether or not they choose to cash this is up to them but until they have the payment the 40 days does not start.0 -

Thanks so much Kevin for the letter. SIL is never in credit so would they accept to withdraw £10 from an already over the limit account?

I don't believe you can. The statute of limitations is the legal schpeal detailing the optimum length of time that one can wait before filing a lawsuit. It protects both ways. They couldn't chase you for a debt that you hadn't acknowledged after 6 years, and therefore you can't try and claim back money that you happily (not) handed over and didn't query.

I'm not planning to claim back all my bank charges for the last six years, but I do want to claim my Barclaycard charges for the last year back - last month they charged me £138 on a £400 balance.
Does anyone have experience of claiming from Barclaycard, and can anyone confirm whether the same procedure applies as for bank charges?
