If you click on my sig ang go to CAG, we have 2 incredibly helpful Scots, Robertcx and Scotia, who have been through the Scottish system plenty of time, and I'm sure they'll be able to set your mind at rest.
Tbh, there are plenty of times where even after winning in court you would not get your money, if the defendant has done a runner, has gone bankrupt, etc... And the HM Courts website does say that... In the case of the bank, it would be difficult to imagine this, and I can only imagine that the dragon woman was talking in generalities!

If you request statements by phone, it's not a SAR under DPA. You need to write and you need to enclose £10 payment. (the 40 days does not start until they receive payment) Clearly mark your letter as a SAR, if you're going to drop it at your branch.0 -
can someone just clarify something for me
I have paid the court fee etc, apparently llods are defending. FIne. BUt what happens now, do they have to submit paperwork for the court to defend ? Or what? I dont know when the court date is or anything and the annoyance is that we are mising quite a lot of post here at the mo so i have no idea whats going on. Do I wait for something to happen? Or am I meant to be doing something???:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

That buys them an extra 28 days to wonder if there's any way they could make you drop your case... ah no, sorry, lodge a defence. :rolleyes:
Natwest have a tendency to leave till last minute to settle. In my case, they were 1 week away from their defence deadline.0 -

They have now 28 days to submit a defence to the court. When they have, the court will send you a copy of it with the Allocation Questionnaire for you to fill in and return.0 -

Result folks. Just received a letter today form BoS. After sending them a summons with a return date of 14th July they gave in and refunded £289 plus£29.47 interest and the £39 court fee. They said they had Acknowledged the claim and informed the court that they would defend the claim. However it would be more cost efficient to pay up. I now have to write to the court to verify that they are settling up to my satisfaction.
They still mutter on about the terms and conditions I agreed to be bound by etc.
A question I need to ask is that while the court thing was going on they continued to add charges to the account. Around £96. Should I ask them to refund that by visiting the bank or letter them, or is there a better way?
PS: I went through the Scottish Court System.0
