    Time just goes so slow when you are waiting for the 14 day to pass before you can do anything else....

    Hey everyone,

    **Note - I am claiming in Scotland so court system different than in England**

    Phoned the court this morning (yesterday was return day) and the bank have not submitted a response so I have won by default - yay!

    However, all is not so simple. According to the (not helpful in the slightest) ladies at my Sheriff Court, I have to return Form 11 by Thursday (fine). 14 days after this, they will send me an extract decree. I photocopy this and send to my bank with a covering letter stipulating time period in which I request repayment by. Send this recorded delivery. Then I expect the bank to pay within the time limit. If they do not, then I can get the courts reinvolved.

    Ok - has anyone else been in this position in Scotland with any bank/court and had to go through this protracted process? The one thing the (frankly quite horrible) lady did say to me, was that there is no certainty of getting my money back - !!!!!!? Surely if I win by default, that's the whole point!?? I would have also expected them to help more with the recovery of the money - please - can anyone give me any advice/help/support who has been through this process?

    Afraid I don't know anything about your situation but wanted to say well done! :j

    Although regarding if the bank doesn't pay then surely this is when the courts authorise for the ballifs to be sent in? :confused:

    I'm not much help either, I'm afraid, on the legal stuff! But I just wanted to say I'll be crossing my fingers that it doesn't end up being as complicated as it sounds and you get your money with the minimum of hassle. You've won (even if by default) so surely some court will enforce the payment to you?!

    Natwest are being right awkward about getting statements for my bank charges.

    I requested statements in the Bank on the 8th of May. They still hadn't got back to me on Saturday, so In rang them to complain. The chap promised that the manager of Natwest Victoria would ring me back on Monday. He never bothered.

    I rang them today, and they put me through to a random in the bank who took my details and promised to ring me back. I've decided if they can't get my statements today, I'll tell them to stuff it and drop the DPA requests in the door tomorrow.

    Any ideas?

    Did you include the cheque for £10?

    They took a while to send mine and when they did arrive they came in a tatty envelope and 2 years worth were missing! :mad:

    No, take them to court. The yare breaking the law by doing this. The yare dragging this out so you dont get whats yours. Dont allow it is my advice ;)

    I agree! Just persist with them they have to give you them!

    I have sent my letter for charges refund to Capital One on Friday so is it 2 weeks i wait?
    Money debited for statements on friday so should get them soon cant wait to take Natwest down!!!

    I need to get MY money back!!!
