No you can still claim back from old accounts as long as the charges were within the last 6 years.

Sign up to this forum and read all the Q&A's and step by step instructions. Then read them again and again. It takes a while to get your head round. I still haven't got much of a clue :p but you will get help on that site and this one!

    Good luck! :D

Flippin' 'eck! Just been talking about it with my husband. He didn't believe me at first. It's a travesty that this isn't generally known. I'm sure there are thousands of people who are owed money and don't know that they can claim it.

We are definately going to sit down and have a read of it tonight. It's a hassle, but a very fruitful one if it goes to plan!

    Thanks for your help!

No worries. Just familiarise yourself with every step, even before you start. You should also realise that you could end up in court claiming. It's unlikely but a real possibility. I'm currently at the stage where I have just notified that I'm taking Natwest to court. They now have 28 days to pay up or enter into a defence! I'm praying it's the former! :rotfl:

    Hi Southern Scouser,

Did you just claim for Unpaid Direct Debit and OverDraft Excess Fee?

Or, to make it easier, could you direct me to the FAQ or step by step guide on here??

    thankyou....

I claimed for direct debits that were cleared despite not having enough funds in my account. I also claimed for the £14 a month/time they charged me for being over my overdraft limit. Always as a result of them charging me initially.

Have you signed up to the Consumer Action website. They have full guides and Q&A's on there. :D

I had loads of direct debits that were returned as there wasnot enough money in my account, then they would charge me £30.

also when ever I went over my overdraft, they charged me laods to.

I have registared on the Consumer Action Website so will have a look there.

    Thankyou for your help.

Just a word of warning, after claiming back my charges from Nationwide, I got a letter from them today giving me 30 days notice that they are closing my account. Luckily I have a parachute set up, but this seems to be the latest tactic - pay off the charges before it goes to court and then close the account so they don't have to put up with us stroppy customers any more!

  • Hey everyone,

**Note - I am claiming in Scotland so court system different than in England**

Phoned the court this morning (yesterday was return day) and the bank have not submitted a response so I have won by default - yay!

However, all is not so simple. According to the (not helpful in the slightest) ladies at my Sheriff Court, I have to return Form 11 by Thursday (fine). 14 days after this, they will send me an extract decree. I photocopy this and send to my bank with a covering letter stipulating time period in which I request repayment by. Send this recorded delivery. Then I expect the bank to pay within the time limit. If they do not, then I can get the courts reinvolved.

Ok - has anyone else been in this position in Scotland with any bank/court and had to go through this protracted process? The one thing the (frankly quite horrible) lady did say to me, was that there is no certainty of getting my money back - !!!!!!? Surely if I win by default, that's the whole point!?? I would have also expected them to help more with the recovery of the money - please - can anyone give me any advice/help/support who has been through this process?

    Thank you so much
