Sent Monument the first letter asking for all charges to be refunded since the start of the account. They then sent a nice letter with the leaflet for their procedure and the FO address etc. I then realised that I was claiming charges without any clue of how much money was actually involved. So I sent a DPA letter asking for the charges, the dates, the reason and details of any manual intervention. Cheque cashed on the 8th, no info yet.

Today I received another letter from Monument offering £132 as a good will gesture. They said I had been claiming £264 (news to me) and they were meeting me halfway. Of course they still maintained their charges were lawful and that I had signed the agreement with those conditions in it.

In this letter I feel they defeating their own argument by making this statement.
"At Monument we believe it is fair that when a customer pays us late or the balance on the account exceeds the agreed credit limit, the costs we incur are borne by the customer."

I don't know anyone on this thread or any other to do with charges who will disagree with this. If they believe this, then why do they charge £24 every time something happens on the account. Why not jut recover their costs.

Of course they are getting told were to put there offer in the politest possible fashion.

Also, Return date for BOS 14th July. They are completely ignoring me now.
    Ya beauty.

    Hi Everyone!!

If I havent had a response by 22nd June then its time for me to make a claim!

I havent even had any response to my 2nd letter which I thought was a bit odd....

Has anyone actually been taken to court as yet? I'm worried, what with leaving the country, that I might be the one that does have to?!

Southern Scouser - how are you getting on with your charges??

    xx

    I knew they'd make you smile! :p;)

Did you get a response from your 'Request of refund of charges' letter?

If you don't get a response from the LBA letter in the stated time then you can start with moneyclaim. Its better that way anyway. I was claiming £777 but now with the interest it's gone up to £1047.51 plus the £120 court fee thingy that I had to pay! :j
  • ooh exciting, I've just sent my letter requesting refund today 1st class recorded to my old bank for over £4K, I still have a grand to claim.

Need to send DPA's next to my CC's, told a few friends and they are watching to see what happens, so 14 days and counting

I am so sorry if this is a stupid wuestion, but I cant find the information anywhere...

All I want to confirm is what charges we can claim back...

I have printed out my statements, and I have the followng charges....

    Unpaid Direct Debit
    OverDraft Excess Fee

Are these both ok to claim back? Or have I missed anything?

    thankyou so much!

This is a rather large thread and it'd be like looking for a needle in a haystack - but can I just ask a simple question - both me and my husband have a number of outstanding debts (overdrafts) with banks. The accounts have been closed but we are still paying them off. It's fair to say that most of what we are paying is charges. Are we able to claim back for these, or is it just accounts that you are currently still using?

No you can still claim back from old accounts as long as the charges were within the last 6 years.

Sign up to this forum and read all the Q&A's and step by step instructions. Then read them again and again. It takes a while to get your head round. I still haven't got much of a clue :p but you will get help on that site and this one!

    Good luck! :D
