The charges they are imposing just now are the result of me forgetting to cancel a £2 direct debit to the NSPCC in combination with the fact I was just over £5 overdrawn when £2 was requested. The £5.xx overdraft happened when I used my Debit card to draw £10 from the cashline machine. I never knew that you could draw more than you actually had in the account using a debit card.
I will await the response from the summons being served, happy that the current charges can be added to my claim when it is finalised.
As it stands at the moment if I got the charges I asked for refunded, the account would be in the black again.
In short I owe them £5 + coppers due to the debit card withdrawal, the rest of the current overdraft is made up of their charges.

I have a question, that I'm sure had been asked before but I can't find it!
I'm seriously thinking of reclaiming my bank charges but I'm worried that a) I'll get penalised in some way because it was my fault for going overdrawn and b) my current overdraft will be asked to be paid in full if they decide to close my account down. It's with HSBC and my current overdraft has been made tons worse by charges on cheques that I wrote without looking at my balance first (very irresponsible I know, I have learned my lesson). Apart from the fees for being over my limit, I was also charged £35 per cheque they paid out. They didn't bounce any cheques even though I was going over my limit.

Yes you can claim them back.
You might want to open a seperate new bank account in case HSBC decide to close your account. some banks are doing this.

Right I have gone through 2 x credit cards statements both mine and pauls MBNA about £500 worth of charges - can't beleive we sat back and took then - they really do hit you when your down.....and have asked the bank for copy statements one step closer to hopefully reclaiming charges to throw at my debts - is it an idea to do this one at a time incase they close the accounts down - I have another joint bank account with HSBC incase smile close me down. Phew I am going to be busy and in a way am excited is this normal!!!Lightbulb moment 10-06-06

I have just sent a DPA letter to Halifax (my current bank), and RBS (old bank) - i don't know the exact totals, but i think it is probably in the region of 2500 for both combined - it is 4 1/2 years of Hal charges, and 18 months of RBS. I will be putting my reclaimed charges into repaying horrible debt!0

Hey after reading the forums i have decided to fight my bank (Natwest) for what must be about £600 in charges over the past year! I am a student and they do insist on charging me! I have a letter ready to send but am just wondering where is the best place to send it? What is the first letter most of you have sent? I want my money back!!!! Hope you can help!!!0

Also start a thread on there, they need to keep track of all the stuff thats going on
They will have the address to send it to on thier forum under "natwest"

Also note you'll need to register (all free of course) to see certain sections. I believe the library is one of these.
A lot of people go on the site and can't find it because they don't know this.
Have a good read of the FAQs - it takes a while to get your head round it all - before asking any quetions that might be answered in them. The mods on the CAG site are very busy at the moment due to the recent publicity but they're all very helpful.

I'm going to try and keep this short as most of has been said already.
Sent initial letter to BOS. Replied with nice sorry letter and leaflet re Ombudsman.
Sent second letter telling them I was not happy and was going to court. Replied with offer of £60 in full and final...... (Claiming £318)
Ignored this and sent summons. Return date is 14th July.
Stopped putting salary into BOS account but forgot to cancel a direct debit for £2 to NSPCC. Result - £78 in charges.
Prior to the first charge of £39 I was £3.33 in the black. After the first charge 35.67 in red. Then the follow up charge for OD >£30, now £74.67 in red.
The letter they sent included the following text.
Your account is currently in a debit balance contrary to the terms and conditions of the account which state that "you must not let your account go overdrawn" and "you must also immediately pay us the amount you are overdrawn (and any charges) so that you are no longer overdrawn".
This one is GOOD. You are in breach of these condtions because without our agreement you have used your account or allowed SOMEONE ELSE to use it so as to make your account overdrawn.
They then go on to threaten with debt collection agencies and/or legal proceedings.
In a nut shell they imposed unlawful charges to my account, that was until then in the black. Then because there is no money getting paid in they are going to close the account and demand payment. I had previously asked them to close that account to avoid this very situation. I don't know whether this letter is due to the summons I served them or whether it's to do with removal of the salary. I think it's the latter. Any opinions?0
