Can you do this on-line? If so where?
Also, all my charges are from either bounced DD's, bounced cheques or over my OD fee's, can I add the interest onto my total amount in this claim?
Im really scared that Im going to be the first person they make an example of and refuse to budge
Yes - https://www.moneygov.co.uk, if you're in England or Wales. Not if you're in Scotland, then it's your local Sheriff's court. I've heard that NI is starting online, I don't have all the info as yet.
Yes - 8% Statutory interest. There is a spreadsheet on CAG to help you work this out.
Who can tell? I personally doubt it, as to "make an example", as you put it, they would have to be sure to win... They're not. If they were, they already woud have done it and with a nice big juicy clain, just to make sure.0 -
DavyM wrote:Recently sent a Small Claims summons to BOS. In the mean time I opened another account with Lloyds TSB. No money is now going into the BOS account. The BOS account is however still in OD and they are still piling in charges despite a (verbal) request to close the account and stop this very thing happening. Do I need to clear the balance before they will close it or are they deliberately keeping it open to charge on and on?
Anyone know what I should do?
Cheers!!
Doesn't matter what they do. When it's time for them to settle your court claim in full, make sure you tell them you want the added charges since you issued claim taken out, and the account closed. Is there any part of the o/d that's actually money you did borrow? You need to keep track so that you know what you do owe and what you don't. They can keep account open if there's money there that you actually owe, as opposed to charges. Or you could clear the balance if it doesn't cause you difficulties and then sue for the return of the charges. Judgment call.0 -

SS, I KNOW you're on CAG as well! There are guide notes for completing MCOL forms there! I think s/one also posted a template that will fit in the 1080/24 criteria.0 -

They shouldn't, and as far as I know, they haven't so far.
But who knows how far they'll go in their attempts to coerce us into not reclaiming what's ours??? We have established by now they are not afraid of deceit, outrights lies and bending the law to their purposes, so who can tell???0 -
I got my statement from Lloyds today with a little leaflet about changes to t&c's.
seems the charge for going over your limit, late payments etc. has dropped from £20 to £12
seems like we're making more of an impact than you think!!
well done all dfw's who are reclaiming their charges

Hi
I am just in the middle of doing my SOA - to be posted later for much appreciated advice and I can accross this bank charges post.
I have calculated my charges from smile internet bank and it come to about £500 but this is only from last septemeber - I have asked them fro previous statements.
Has anyone claimed back from smile? I would be interested to see how it has gone. Can you try and claim back their service charge and daily charge that they put on everymonthif you are over your overdraft limit doesanyone know?
I will go through my credit card statemenst tonight to see what I can tryto claim back there - I am sure there is a few charges.
I have credit cards with egg, citi, accucard and mbna and my husband is with egg barclaycard and mbna has annyone tried a claim withthese?
It is quite exciting really if the claim is granted then it will clear my overdfat and that will be one tick one my debts.

I sent my request for a list of charges to Head office - registered post on the 14th May and have still not heard from them. I know that they have 40 days but you heard back from them really quickly! Well done for not accepting their pitiful offer!

There is a separate thread for Smile I beleive on the CAG forums. Same for Egg, citi, MBNA etc.
You can't claim back service charges that you pay regularly for your account or any other specific service.0
