Any ideas what address I would use for a money claim against Halifax credit card company. Their address is in Scotland so Moneyclaim online wont acceopt that as a defendant address.

I went to the local sheriff court for my forms. They also provided an excellent guide with examples of what to put where. The main sections on the form (I'm in Scotland by the way) are sections 4 and 7, it may differ slightly in England (for the cup) and Wales.

Most of the questions are just about your details, the details of the culprits (Banks, Credit Card Company) and about who is representing you, if anyone.

The other questions are about how much of YOUR money you want them to return to you and any additional interest and expenses. A hundred well chosen words will suffice. Check out the CAG website for suggested text. Also good stuff at the Which? site.

You need to repeat the stuff you put in your part of the form into the Defenders' part of it. Copy and Paste is pretty handy if you know how to do it and your doing it on the PC. I got the paper copies, then downloaded the electronic form and filled it in on the computer and printed it off. I can't use Moneyclaim as it isn't available in Scotland.

You should include a list of the items you are claiming, i.e the charges you want refunded, when they were charged to your account and why they were charged to your account.

Any way, don't be scared of the forms or the Sheriff Clerks. All you are doing is asking for your own money to be returned to you. The clerks at court just get on with, no stigma attached. This is my first go at this, thanks to the sharing people on this site. So I know how you are feeling. Go for it, they can't shoot you and from what I can make from all the sites I've visited they won't turn up at court, although you must turn up.

Incidentally, I received the exact same offer of £60 in full and final settlement from BOS the very day I handed in my summons form to the Sheriff Court. Do you think it's a standard letter LOL, was the signature written in pen? Bet not. Also bet the logo was in black and not in colour.

    Fishface,
Basically, say you over your overdraft by a quid. You'll then be charges say 30.00 for going over. The interest part of it to claim for is the interest charged on that £30.00 for that time. Not the interest on the overdraft ( ie mines about £6 a month) (and not the interest on the quid either!) but the pence of the interest charged on the "charge" Its a nightmare to explin, andI found it impossible to work out, which is why I just asked for the charges themselves back.

if you use the spreadsheet on the CAG website it works out the overdraft interest for you.

Yes, sorry about that, folks. Things went manic as soon as the web address appeared on the tv, I'm afraid!

Hopefully, things will get back to normal soon, just post your queries here for the time being, and on the other bank charges thread, and the CAG moderators will answer as fast as we can.
  • Hi, Im new to all this and I too live in Scotland and am about to go to court. The question I have is that the money claim website says you must have an address in either England or Wales. Is there a different site that needs to be used?

No. In order to go to court in Scotland, you will have to file with your Sheriff's Court in person, MCOL doesn't accept Scottish addresses.

I have my case against barclays and I am waiting for a date for court. The problem is im not so good in face to face situations. I understand the basics of it but I need some help to come up with a game plan. I have read on the BAG website, but im not the most confident of people, even a little timid.

I was trying to search on the BAG website to see if any cases had progressed since i last looked because it seems that Barlcays are determined to defend in court :(

Anyone know how far advanced the most advanced barclays cases are ?
