    they have three days now, as theyve been heel dragging for such a long time.

    Im absolutely furious.

    THE IC isnt worth much I dont reckon, but of course I will be doing it anyway.

    I wonder how much compo I can get from them flagrantly breaking the law :rolleyes:

    Recently sent a Small Claims summons to BOS. In the mean time I opened another account with Lloyds TSB. No money is now going into the BOS account. The BOS account is however still in OD and they are still piling in charges despite a (verbal) request to close the account and stop this very thing happening. Do I need to clear the balance before they will close it or are they deliberately keeping it open to charge on and on?

    Anyone know what I should do?

    I think we all think that. If they do try to make an "example" of anyone it will likely be for a large sum so they can justify the cost of fighting it. They don't really want to have a precedent set, or they wouldn't bodyswerve the court at every turn. I get the impression they're all learning to drag things out to the maximum and then only pack it in at the very last minute. Has anyone recently been refunded without going to court?

    In any case what choice have you got if you want it back. Tory Blair and his mates don't want to do anything about, so they use the OFT and other "buffer" organisations to make it seem as if things are going to get better.

    I watched Trevor McDonald the other night and saw great success stories. But even Martin Lewis said that eventually the banks will fight back. I don't see what they can do if what they are doing is illegal.

    Go ahead with it. Once it's in, it's in. Then sit back and wait. If they enter a defence you will need to show up on the day so you don't have pay out any more than you have.

    Has anyone filled in the Moneyclaim website form? I'm confused as what to put in the "particulars of claim" bit. :confused:

  • I'm right at the beginning of this journey - I sent my letter for statements etc to Capital One this week and also one for my daughter to Halifax bank and CC. I would love to do them all at once but need to be careful in case they start closing cards down and asking for the money back!! WIsh me luck - I keep reading all the posts for inspiration. Does anyone know whether Halifax try to close current accounts down if you claim against the credit card? They keep telling me that the credit card people are different but they have the same registered address. :hello:

    That wasn't Barclays. We've had 2 court appearances this week, both with Abbey, but they weren't hearings for the charges as such, they were set-asides hearings. Basically, these 2 folks each got a default judgment againt Abbey and Abbey then asked judge to set aside the default so they could present a defence. The judge granted it (they usually do) and now a date has to be set for a full hearing.

    I'll guess the banks will settle both those cases within the fortnight.

    And to update on this, the bank settled BOTH those users' claims yesterday in full. :D

    It feels GOOD to be RIGHT!!!!! :D
