    thing is im not too sure.

    I think seminole cleared it up for me, do I just sit tight. I have not seen a document which is theri defence although they said they would enter one??

    That's great! I'm waiting to hear details of charges from Cap one - glad to hear they are paying out!! Did you have to wait ages for the information or were you organised enought o have it already?


    It didn't take too long for the statements to arrive - less than a week and I didn't have to pay for them either. Brucy bonus!

  • Received letter from Halifax this morning, following my letter before action. They have told me that following my refusal of their first two goodwill gestures (£95.00 and £280.00) they are not prepared to refund my charges, and suggest I make complaint to the Ombudsmen Service.

    Its now time to follow through my threat of court action with them. Should I do this straight away. They still have 4 days before the end of the 14 day deadline so do I have to wait until then?

    Lthough I am determined to go through with it, now crunch time is here I am getting a little nervous. People around me keep telling me no chance and they will stand up in court and defend blah blah. I know from the responses on here so far that the odds are in my favour, but I am now going into unknown territory and its a little scary.

    Just received all of the girlfriends statements (and they never cahed my cheque for £10) and have totalled up the charges which come to £920, can anyone help me and point me in the direction of the next step please. Thankyou

    you need to go back to the https://www.consumeractiongroup.com FAQs, it will tell you the next steps, and give you templates for the letters you need to send :D

    Having sent all the necessary drafted letters to my bank regarding their unfair charges they, about two months ago, refunded one charge of £35.00 as a gesture of 'goodwill':naughty: . I, as you can understand, was not happy with this outcome and actually followed through with my intention of making a claim against them.

    Two weeks ago I received a letter from Northampton courts advising me that my banks solicitors were to defand all of the claim. I though 'great, this is never gonna work'.......then today I check my bank account for a completely different matter and notice that a cheque for £212.83 has been paid in?:confused:

    I initially though that somehow there had been an error on my account and pondered the idea of withdrawing the money and pleading ignorance :huh: when they requested it back. Then I thought to check how much I was claiming from my bank and, would you know it - £212.83!

    It worked and the money could not have come at a better time as we are moving tomorrow and really need the extra readies!:T

    Do it. The worst that can happen is that you loose your admin fee. I felt exactly the same as you when it got to the 'crunch' but thought what the heck and now I'm £212.83 better of.

    Ive recieved a letter from the halofax confirming that they are returnng my bank charges and court fees to the value of £880 :) They have paid this money into my bank account which is frozen de to my dmp but at least I WON!!

    Ive also recieved a letter from halifax visa today sying that my statements are on order.....case number 2 is about to start :)

    My OH was charged £25 for going overdrawn on an account that didn't have an authorised overdraft and then they charged another £25 for a payment transfer when there were insufficient funds - sounds to us like they are charging twice for the same thing. The short version is that we got a refund.

    Here's what happened...

    Transfer request from another bank made on Friday 23rd to go into A&L current account.
    An SO made from A&L current account to Saving Account on 28th to A&L savings account.
    Original Transfer didn't arrive until 29th so went over drawn.
    Phone call made to CS on Friday 30th and refund achieved (eventually) by standing our ground! We were going to use the line "We will be seeking legal advice on this matter" but didn't need to.

    Thanks due to this site and its contributors for giving us the courage and knowledge to try.

    These internet bank transfers are a scandal. It is all computer controlled so why are weekends not the same as working days now!
