    Hi
    I have just had a response from Capital One after sending off my preliminary letter requesting £700 worth of charges back.They have offered me £185 which i am not accepting. I have just written the next letter
    LBA----and that will be posted tomorrow recorded delivery. I will keep you updated as to the outcome.

    I think it would be better to write a different letter, but obviously very much along the same lines.

    Maybe compose your own? That's what I did. I thought I had messed up too, sent the prelim and LBA but then they refunded a few charges (not all of them) and I felt like I couldn't make a claim without acknowledging the refund and giving them another chance - also they didn't refund until after the 14 days were up but as I hadn't given them an acutal date it all felt very ambiguous.

    I felt like I was taking more control by writing a final letter before action and acknowledging the refund and giving them a deadline to comply by. Which they didn't so now it's with moneyclaim, but I was happier then because I'd taken some control of the situation.

    I think in these types of situations you do need to set clear deadlines and adhere to them, then everyone is very clear about what is being requested and by when.

    If you take a look at my thread in Capital One (taking on capital one - the one with the most views incidentally :) ) you will see in post 23 my final letter before action. That'll give you some ideas. Just a very basic letter. I find it easier to write a basic letter that I have composed myself so at least I fully understand it rather than trying to shoehorn one of the templates into my situation and not understanding what half of it means, IYSWIM.

    Hi lynzpower,

    From what I understand you didn't really do anything wrong. The banks undoubtedly now have a process line to deal with the whole issue, so regardless of what stage you start at, it will get allocated to the right place and continue along the pipeline until conclusion.

    The only important bit you don't get wrong is when you file your actual claim with the county court service, as it might get stayed on a technicality or something which wouldn't be good.

    You'll be fine, don't worry :)

    God I know some are a bit scary over there, but in fairness many of use are from here too lol

    Cheers Glitterari, I'll chack out your letter. KNow exactly what you mean about the shoehorning, I took the interest part out of it, I just couldnt fathom how much it was and i guess under £50 so i thought, stuff it,. 1107 is perfectly acceptable!

    Me too, i couldn't be bothered with the interest bit - it's bad enough working out the 8% interest if you issue a claim - i thought well they can keep that other interest!
