I have a buyer who keeps asking for my nochex account details so he can make payment, then claims my account isn't setup correctly. He ignores my requests for payment, then claims to work for nochex.

I have filed a non paying bidder alert and as its a large amount want to send him a letter can anyone tell me if below quote is enough to say

On the 1st April 2006, you entered a legally binding contract to purchase from us eBay Item Number 9118484763, Mega Sim Card Bundle, Total Due £50.99.

After numerous reminders you have chosen to ignore this legally binding contract and not make payment, I am afraid this is against eBay rules as you are aware a non-paying bidder alert has been filed against you, this can lead to your permanent suspension of ebay priviledges.

Unfortunately this is not the end of the matter, as you entered a legally binding contract to purchase this item, payment is still outstanding please send payment to us within seven days to avoid further action being taken, this will lead to our legal expenses being added to the original amount.

    Any help appreciated

My only issue is - is it really a legally binding contract? I didn't think it was, and if it's not perhaps it's unwise to use the phrase 3 times.

Unfortunately he'll probably know that any threatened 'further action' is prohibitively expensive, and most people are only bluffing when they threaten it.

I don't know much about nochex... I do have an account but have never received a payment. Surely all he needs to know is the correct email address linked to the account... what's to confuse?

I've had similar dealings with people from that part of the world - them seem the least able to understand the problem - Ive even had one ask which State I Was in - that took a few emails to get them to understand that I was a different continent to them

But I would have email the buyer the same as you - always include the Royal Mail Link, and also a Dollar / pound exchange rate link if you can - and reiterate a lot that $1 does not equal £1

    Good luck with them

The reason most americans cough at postage costs is that they don't believe life exists outside of the US!!

I also found out at the weekend, at a party my little girl went to, that all US bases have US post offices on them, so personnel in foriegn countries don't get stung on postal charges back home.

We had on buyer who bid and then claimed she didn't realise that the £5 postal charge for a foot spa was UK only. (What part of EMAIL for Foriegn Postage did she not understand?) Eventually had to npb her which she responded to by saying our postal charges were too high and that she couldn't wait that long for delivery!!!

Are all americans stupid, or just the ones on ebay?

I had an American buyer not pay correct postage too! I emailed them about it and they apologised and paid, but for a while I was worried I'd have an awkward buyer

And assuming it used electricity it wouldn't work in the states anyway.
  • Further to my Rant on monday!!! my American buyer appears to have ignored my email offering to use a courier of her choice but she has marked the items as Payment sent!!!

Im guessing at some point a cheque for good old US Dollars is going to turn up, what a shame i dont accept cheques from overseas!!

I just cant wait to see how much its for either. Its certainly making me think twice about opening up my auctions to the USA, though i have had some incredibly nice buyers from there and it seems a shame that some spoil it!!
