    Signed contract or not, that is quite unenforcable and if they tried to use it as a basis for witholding a degree, they would fall flat on their face at the first legal hurdle - namely that any charge imposed must be reasonable and proportional to the costs involved.

    Anyway, W.Kent College ain't Cambridge and you can't compare UKPC and their operation to a staff Proctor. :rolleyes:

    Yes the fees for parking may be unenforceable in a court of law, however, it will be far more damaging to the OP's child if this was to hamper their education or they couldnt graduate or proceed whilst fighting this thus their is an argument life may be far easier paying up and not taking the risk.

    OP whilst this may not be upheld in a court of law do you or your daughter really want to spend many weeks/months fighting this, creating disagreement with the instituation and generally risking her long term education for the sake of £40 quid.

    You need to speak to the college and see if this "debt" would result in such action. If so take the easily (and unfortunate) option and pay up.

    Its all great people like pogo etc spouting the legal points but its not their education or long term future that may be affected as a side effect.

    Who issues the parking permit & what are the costs of a years parking in a pay & display half a mile away?

    Without knowing whats in the policy document you know NOTHING.

    The facts are quite clear - The OP's daughter has a ticket from a PPC.

    Once the permit was sorted, there are no further issues with the college or its policy and she can go on treating UKPC like any other parking predator.

    The OP also quantified the applicable costs to students beyond the permit - nothing. So your comparison with any nearby P&D is disingenuous.

    She also raised another issue of negligence that may be very applicable to the college's parking policy but that is a whole other argument. ;)

    Payments from a PPC to its clients are invariably ex-gratia. Which means that there is no question or recognition of liability, legal obligation or responsibility. This works both ways.

    Therefore, there is absolutely no chance of this money being considered as "owed", nor the issue of non-payment following her back to the college. None at all!

    Now please, stop trying to scare the OP into paying-up or further confirming her identity to the PPC - all that will do is prolong her harrassment by them.

    If the college consider it owed and withold an award or progression I am sure the OP wont be bothered eh.

    Especially at this time of year.

    Say college withhold progression and its fought in court and runs into the new academic year. the OP's daughter would then need to put their education back a year.

    OP give serious consideration to the actual outcome rather than the perfect outcome.

    The college get informed OP's daughter hasnt paid for parking permit/penalty notice.

    College advise no progression til paid.

    You really are not living in the real world of how colleges etc act.
