over a pair of shoes costing £30..
maybe its time to stop playing silly games and accept that sometimes technology breaks, and you didn't win the shoes.

I am not legally trained. I know I have posted flippant and frivolous comments on this thread, but please, if you have seriously instructed a solicitor you need to be careful.

You cannot claim in English Courts for hurt feelings or distress. You have to show a visible loss. You have to prove you made the bid, which will almost certainly require expert reports, which are expensive, and you will have court fees and solicitors fees - and any solicitor charging you less than £100 per hour plus vat plus disbursements is not to be trusted. Unless the shoes are very specific and your tangible loss is more than £5k then it will be heard in the Small Claims Court. The amount you can claim from the other side in costs in addition to your loss is capped in the Small Claims Court - it used to be less than £200 back when I was there, which is less than two hours of your solicitor's time. It will take more than two hours to prepare a case.
Do you have a trusted friend or relative that can check what is going on legally? Someone who you can trust to tell you the truth, even if you don't want to hear it?
I cannot see anyway that there is a claim, but like I said, I am not legally trained. I cannot see that it will not cost more to issue a claim than any potential restitution.

There is nothing at all wrong with the policy that if you win you win. You have obviously got yourself muddled between the two pairs of shoes, I can find no instance at all anywhere of any other complaints about winning bids not actually winning.
Go back, check your information carefully, double check it and then get someone else to check. If you have been the first person in several million to have this problem I still don't think it worth bankrupting yourself over. You're delusional and a pest to others. I suggest you look at your own 'positive' feedback from poor sellers who have dealt with you and question a) how honest and right-on you really are and b) whether ebay would care a jot about you kicking off about, and do I need to repeat this along with others, a transaction that....never existed! You're wasting people's time and/or giving them a bit of a laugh at your queer attitude. I'm sure you don't want that so perhaps you'll learn to desist with this at some point.0 -
I'm an adult with bipolar disorder who has a tendency to overspend wildly in manic phrases, so I use his account to sell things in order to repay some of the debts run up during times like that in the past.. But thanks for your uninformed judgement :rolleyes:

I have to be so careful - a lot of things are not what they seem on ebay.
I bought a pair of stockings from ebay. Dear heart was very disturbed because not only was the picture showing them modelled by a man but they came with instructions about how to put them on.
