You know I remember a time when you came onto this site and people were helpful, they listened and if they had something constructive to say they did, they didn't !!!!!, I wondered what has happened to all those polite, sincere people. Maybe caught up with all this money saving and don't really care or listen.

    Shame really!

as far as i can see everyone was being helpful about your general problem regarding your insurance claim, nobody had anything to add about the risk to your children or yourself so they kept quiet about it as its of no real consequence to your actual problem, thats up to you to deal with it how you wish. if you wanted hugs and smileys you should have just asked :grouphug:

Does anyone actually get that it could have been my children that got hit by someone driving too fast or are we all just interested in Legalities.

But they wasn't was they? So that comment needs to be put to bed if it was to go to Court...

I was involved in an accident a few years ago. I pulled out onto someone. They T-boned me and wanted to take me to Court for £3000 of damage to their !!!!!! old Range Rover (the bonnet was dented by the bull bars).

But they forgot to tell their ins company that it happened in a car park, so it just went 50/50 as it isn't classed as Public Highway.

    Hi there

I just needed some advice after in an accident with the Postie van (Ford Ranger), he was coming doing by driveway where he had good visibility at the top and partial on the way down of the road I was on, I was at the bottom coming up and had some visibility up to a point but he must have been behind my house at the time came round a corner and he slammed into the front of my car causing my car to be written off his Ford Ranger only having £300 of damage. I should say it was a steep hill and he was coming down to fast although I have no witnesses so as a result it will probably be 50/50.

My insurance company as I had no legal cover have advised me to get a soliciter as I was injured and I should claim 50% of the claim although they are going to try and fight it so that is is more. Does anyone know of a good company to try, I would rather do no win no fee?

Also and this is my main point which I am going to have to rant about as no one seems to care, he was coming down my drive without due care and attention in a very large pickup, if I had been walking up the drive with my little boys it would have been much worse as he would not have stopped in time he could have killed us. It was the first time he had been on the run and he didn't know the roads, he at no point admitted liability. Also I am a Royal Mail customer and not once have they been in contact to see if there customer is alright. The lady postie that normally comes and is such a careful driver admitted that she gets into trouble for being late and has been told to put her foot down and get a move on, if only I could get that in writing. Which is why I don't want to particularly get the person who hit me into bother but I do want him to slow down.

Anyway sorry for ranting, please could someone advise me, I would really appreciate it.

    Thanks
    Elaine

    Hi Elaine

I think you should contact your local solicitors, make sure you read the conditional fee agreement they will give you to sign so you understand your liabilities for costs should you lose the clain.

Saying that, you at least have a claim for 50/50. This means your damages for personal injury and uninsured losses will be paid out at 50% only. This will include any loss of earnings, and other expenses.

Most solicitors operate a no win no fee system now so you shouldn't have any problem finding one to act for you.

I know you feel very upset at the possibilty your children could have been hurt, but please, just be happy they weren't. No one wants to see an injured child.

Maybe you could put a warning sign on your drive, and impose a speed limit, its your land, and your property so its something to think about. Certainly have a word with the postmaster at the sorting office just to re-assure yourself that they are aware of the dangers.

There is a strong chance this driver will make a claim against you too. But your solicitor will help deal with that.

It is also possible you might get greater than 50/50 on this as I think in the highway code you are told to give way to vehicles coming up hill. (I am not sure if this will count though).

By the way, if you have not been to your doctors, GO NOW. you will need medical support for your injuries and attending upon your GP is vital to the claim.

Good luck getting this sorted, and be glad your children weren't hurt.

Chill Harveybobbles not taking them to court for what might have happened.

Thanks couponwoman, I am really thankful they were not injured but it could have happened and it makes me feel sick about it. Just thinking out loud really, make sure I don't do that again.

Thankyou though for all your helpful comments couponwoman and I think I am going to put some signs up although it is not actually my property it is the farmers.
