    It is also possible you might get greater than 50/50 on this as I think in the highway code you are told to give way to vehicles coming up hill. (I am not sure if this will count though).

If you see a vehicle coming towards you, or the driver behind wants to overtake, pull into a passing place on your left, or wait opposite a passing place on your right. Give way to vehicles coming uphill whenever you can. If necessary, reverse until you reach a passing place to let the other vehicle pass. Slow down when passing pedestrians, cyclists and horse riders.

    It seems that neither driver saw each other until it was too late, so how would " whenever you can " apply?

    And how do any of us know that " whenever you can " would apply in this case?

    Unfortunately the Highway Code is simply that. A code of conduct and not law, that comes from the Road Traffic Act. If the “driveway” is not maintainable at public expense or the public do not have free access to it then the RTA will not apply.

    Right he could see me as at the top of my house you have full sight of the road below before starting off down the hill. The operative word being hill, the person on the road cannot look behind them and see if there is anything there as that would be dangerous. You turn up the driveway and go back on yourself. Please trust me it is hard to explain, the person on the road does not have the same sight as the person at the top.

    I am not very good at explaining myself am I.

    This is the general rule that i follow but I haven't a clue whether it is in the highway code.

    But it is s sensible guideline and was the standard when cars didn't have sybchromesh and handbrakes were a wish and a prayer. Much easier for the person going downhill to gert moving again.

    If the accident happened on private land can RM sue the land owner if the driveway is not properly maitained and there is no room for two cars to pass at certain points?
