Car accident - help please

    You know Chippy I could run round in circles all day with this but I was not at fault but seen as how it was me and the postie that were there it will probably go 50/50.

    All I asked was for some advice and if anyone knew of a good solicitor, its not really for anyone else to see how it will go and its not helpful. The insurance company will decide and if the decide that I was liable I will fight it just as I am sure the postie would if it went the other way.

    It very hard to describe a road and accident without pictures etc of the situation of the drive etc I would be very upset if they decided to sue the landowner and frankly I would stop pursuing it as I have no wish to involve the landowner as he is a really lovely man.

    I couldn't see how anyone could sue the landowner. There is no chance of that happening. I would be more interested i knowing how the insurance companies will view the accident taking place off "the public highway" I assume it makes no difference .....but you never know.

    OP I really think you will be on a hiding to nothing re any other outcome but 50:50. In retrospect it would have probably been best to get the police out at the time and at least they could have taken statements at the time.

    In my recent accident I told the police what had happened but I did ask them if the witnesses saw it the same way. Even an hour or so after the accident you can start to doubt yourself.

    By all means take legal advice, but be prepared for them to suggest that it would be difficult to prove one way or the other.

    Actually the insurance company said not to phone the police as they are not interested unless someone is seriously injured. I think it will be 50/50 myself but the reason I wanted decent legal advice is that I am going to claim for the whiplash injury I received as it really sore and I am going to have to get physo etc to sort it. I can claim 50% of the compensation seemingly.

    Thankyou for being so level headed about the driveway thing, I was starting to get really worried about the landowner.

    Excuse me please do not judge me by your own standards.

    My neck is injured if it wasn't I would not claim not that should actually have to justify myself to you or anyone.

    The driveway is on private property with full access given to the public does that help.

    OH reckons if anyone is injured then the police must be called to an accident or informed of it as soon as practical but he said private land is different unless it can be deemed the public highway because the public have access to it but he said this is more commonly applied to supermarket and council car parks.

    out of interest, any of you experts know how fast a car would have to be travelling for the driver to sustain whiplash on a sudden stop/impact?

    Well the woman I nudged at about 5-10 mph in her mothers motability car managed to get a claim through for £1,900........:mad:
