Car accident - help please

    As the Royal Mail have already told me each driver is sent on risk assessment training and it is up to them to assess the risk, which I have in writing so I hardly think they could then turn round and tell me the road is not safe, that would mean the drivers are also at fault. Also all the postie's have came up and down that track for years with no problems.

    He really does maintain the track, that is the point I am trying to make it is an excellant track which is why he came down it too fast. Most tracks around here are so bad, the landowner is a farmer but he is also in the business of laying tracks etc its his job and he is good at it.

    You can say what you like in court. Just remember you, on your own, are fighting a huge national company which im sure has their own legal department. We are only trying to help.

    I am sure they will try to wriggle out of it and in the end I don't want the driver to suffer, I just wish we lived in an ideal world where they did not have to rush around to get back to the depot on time.

    Please don't get me wrong I feel bad for the driver and he felt bad he is not allowed to admit liablitity, do you know after the accident they sent him out in another van to deliver the rest of the post, its not right.

    99% of people walk on the same stretch of pavement without falling. 1% will fall over a broken slab and sue the council.

    This issue isn't always with the person but is with the landowner and if he has been negligent in placing someone at risk.

    I'm confused whether it's a track i.e. basically uncovered soil or a driveway i.e tarmac upto normal highway standard?

    It's more than likely that a huge organisation like the Royal Mail, lodge a bond with the High Court and act as Insurers themselves. They will have additional cover to cover claims above a certain limit, say above £100k, but anything below that will be covered in-house.

    What does this mean for you? Well I've only dealt with London Transport who also self insure and if RM are the same, they'll do anything they can to stall, delay, and hope that you go away.

    Yeah, I quite agree with you they will stall etc but it is not likely I will go away. Someone else told me they self insure although the details I was given was for AIG so I am not sure.

    The road is neither tarmac or dirt it is a regular hardcore drive which is normal for this area.

    even though you were given the name of AIG to contact it is still possible that Royal Mail were self insured.

    Some organisations ie local authorities, appoint an insurance company to just manage a claim but any award for compensation would come out of the organisations pocket not the insurance company.

    A few years ago I got hit by a bus. Totally buses fault as I was stationery at red lights and he came around a bend and lost control. Still took 2 years before it was settled as it turned out the driver had "borrowed" the bus to take his mates fishing. I was lucky in that I had legal cover with my full comp insurance but it meant when I wanted to renew my insurance I had an outstanding claim that meant I couldn't get the cheapest quotes.

    Another friend hit by a bus but didn't have fully comp insurance and had to fight them herself. She gave up after 3 years.

    He may not be liable, you could be the one found at fault.
