The Bad News Thread

There's a good news thread here so why not a bad news thread too?

I got a really nasty package arrive this morning containing a wad of paperwork. It seems that despite me making a phone call to the Employment Tribunal Services on the 17th and 21st March to see if my ex employers had submitted their response by the deadline (the 17th) and being twice told that they hadn't - in fact they had :( It arrived this morning and they intend to fight me in the tribunal claiming that I'm not owed any money as I was a freelance and not an employee.

It's really ruined my whole weekend. I'm in no doubt that I'll win (I have everything on my side and I am the one who's been wronged) but to get that unexpected surprise just before the weekend has totally smashed all the happiness I had from expecting a default judgement after they failed to submit a defence.

I phoned up the ET and asked them what the hell was going on and why I was twice told that no response was submitted, but the court stamp on the response says 17th :( They couldn't have avoided the question better if they'd practiced it. I felt totally fobbed off by them :'( TBH, I'm suspicious that it never did receive it on the 17th or my ex employers claim it was sent in and blamed them for an admin error or something because they were late and got it back dated or something (just the sort of thing they'd do). What they submitted was a photocopy of their form which seems weird.

Meh, combined with the problems of trying to open another bank account this week, I'm feeling down and want to run off for the weekend to my OH and sulk a lot :( It never rains but it pours...

    Sorry you are feeling so down. I have some experience of ET's and it's good that they are looking at the case. Sometimes they will reject the application straight away and not even let you fight your case. If you feel confident that you will win, then it doesn't matter that the paperwork has arrived does it .... your employer was bound to deny that they owe you the money! The best defence is always attack as far as they are concerned. Also if they are covered by insurance they have to deny the claim otherwise the insurance company won't pay up in the end when you win!!

    Try to see the positive's in the fact that you have had a response, the ET have not rejected your claim and ultimately you are confident that you will win!! The more your employer argues the more likely it is that they will end up paying your costs and maybe a bit more in compensation.

    Hope your weekend isn't so bad after all.

    You know Lewby, you're entirely right and I know you are. When I entered in to this, it was under the full expectation that I was going to have to go through the entire process, but as they days ticked by and thus came no response, I think I started getting more and more confident that I'd get a default judgement in my favour.

    As the deadline approached, I paniced, was wishing each day would speed past, and I was nervous and anxious that they wouldn't slip their response in the last few days. Then after the 1st phonecall to check they hadn't I was happy but cautious, so I waited a couple of days and checked again and still no response. It was at that point I built my hopes up and got really excited and to receive news now like this has pulled the rug out from under my feet. Just when I thought it was safe to be sure, it turns out it's not :(

    In the response they received, they've been really nasty about me saying things which are blatantly untrue and the description of some events are almost fantasy. I know my ex-boss used cocaine a lot and I seriously think it's messed his judgement up. I showed it to my housemate and she couldn't believe what she was reading. I know I will win at tribunal and thanks for grounding me again Lewby. You've made me feel a bit more confident again with your kind words :)

    I'm sorry to hear that you've had to go through this before as it's not really a nice process I don't think. I hope everything worked out for you :)

  • I've had a letter off Legal and General telling me they are still sorting out my endowment mis-selling complaint.I was hoping it would be nice and easy like Friends Provident was, but looks like I won't be rich for a while yet!

    God I hate money! (unless I've got some of course, rofl!)
    But really is there anything worse than money? It is the only thing that can send me suicidal in a matter of minutes.
    When you've got it everyone wants to give you more - when you haven't got it no one wants to tigve you a penny.
    You can have the best credit rating in the world and a good record with your lenders that goes back years but as soon as you hit a problem - whoosh, all of that counts for nothing and you are suddenly in everyone's black books and treated as though you are a criminal. (except on here of course).
    IT DRIVES ME MAD!!
    Stop looking for answers....
    The most you can hope for are clues.....:)

    Just realised that it's a five week month (I get paid on funny dates). It's also the most expensive month of the year for me: I've got to find money for birthday presents, Mother's Day and Easter all from the same pay cheque. I've just heard that I've got a job interview lined up fairly soon - good news in theory, but I'm going to have to go to the hairdresser's, send my suit to the dry cleaner's and buy a new pair of shoes. Of course it's the first month that I've been tackling my finances and so have no money set aside to deal with all of this. I really had hoped that I could wait until next month for the dry cleaning and hair but no such luck. Grrrr. How on earth am I supposed to get myself on an even keel and start putting money for future expenditure when it's going out so fast? I feel as though I'm never going to get on top of my finances.

    Its so tiring isn't it? the daily struggle of trying to pay Peter without robbing Paul? I know just how you feel. But sadly I don't know how to help. Except maybe look for a mobile hairdresser, they're usually cheaper, or one of the free haircut deals in the magazines. If you are of a regular size could you face a charity shop for your "new" clothes? There are some good buys I believe?
