At the end of the day an education authority may or may not take action over a false, deliberately misleading school place application.

Our solicitor said our buyer was having pressure put on him from all angles (EA, his solicitor, probably his girlfriend and family, too) to do the sensible thing and be patient if he has to. He's only hurting himself if he pulls out. We'll lose money in the short term if this all falls apart, but at least we're on the property ladder and we accepted a very low offer.
Once again I think mis-communication played a part. Our EA said yesterday, "I thought you were going to have vacated the property by Christmas." Um....no. We never said we would do such a thing. If our EA has been telling our buyer that all along, then no wonder our buyer thought this would be done by now.
We're supposed to exchange this morning. Our solicitor said yesterday "you can breathe a sigh of relief now" but we're very skeptical. Some papers are being sent special delivery to our vendor's solicitors, who are going to fax them to our solicitors. If this doesn't happen (and let's face it, this is the useless solicitors I'm talking about), then our solicitor has one last bit of paperwork she can do to make sure our interests are protected. I'm still assuming the worst, just because nearly everything to do with this move has gone wrong.I used to have my Avon turnover (sales) here. They've been removed because it's not appropriate to talk about those kinds of sales as if they're realistic for a new Rep to aim for.I signed up at the right time, right place, and was very lucky.

GRRRRRR!!! Hubby finally got hold of the EA we have been dealing with (I spoke to his assistant the other day) and he told hubby that our buyers are working to a timeline we set?!? Hubby turned around when they agreed to buy our house and said great we would be moved in by his birthday (23rd Jan) so as far as they were concerned that was the date they were working to! But this conflicts with all of the discussions I had with the same EA when we were working to try and move before Christmas! Our solicitor hasnt heard from their solicitor at all and the EA then threw it back at hubby as to how can we be ready if our solicitor hasnt heard from their solicitor. Surely our solicitor shouldve rung etc etc. Hubby gave up and came off the phone (I was getting more and more worked up in the background lol). So the situation is we are as far as we can go with the house we are buying,and they are ready to go, but our buyers are dragging their feet. So fed up! Its gonna cost us the extra vat and stamp duty so we will have nothing left to go towards work we need to do and are left fitting ourselves and 6 kids into a 3bed house. Im still telling myself at least we will all be together, but just wait for all the kids arguments as they all have to share 2 rooms lol!0

not_loaded - that is why I said the LA may take kindly but it's best to check. They may well say you have to be in the area but if she says she is buying in the area and just waiting for it to go through they may let her apply with her inlaws address. It has to be worth a try. I suppose it all depends on how subscribed the school is but if her other children are going there that will help too....0

Yes agreed.
Unfortunately if it's the same for all LEAs as it is here, then the application deadline was November 30th. At that point no more applications will be considered. Places will be allocated to whatever is received by the deadline, according to the rules. One of the rules is a sibling benefit, but the application has to be in in order for this to apply.
Being backward in coming forward gets you nowhere nowadays. I'd have gone for the 'bluff' on it, as by the time they get round to checking, it'll all be done and dusted and there's no dishonesty in the application.
For an oversubscribed school with hard and fast rules there can't be a 'take kindly' attitude.0 -

Well, all the paperwork was in place for exchange on Friday, but we couldn't because our buyer's funds weren't in place. He'd withdrawn them in protest after the failed move last week. I had to ring our EA at home on her mobile yesterday morning to get an idea of what our buyer was thinking. Would he pull out over a problem he'd created? I couldn't have spent the weekend worrying. He's happy with a Tuesday move. So we're exchanging on Monday, but if the funds haven't come through we'll have to exchange and complete on Tuesday. All our solicitors have to do is phone each other, but I don't have much confidence that our vendor's solicitors can even manage that. I'm confident our sale will go through, which is the important one since we need to keep our buyer happy. We may end up in a Travelodge over Christmas if the purchase gets delayed. At the moment I'll happily do that if it prevents our buyer from walking away.
Am being a right Scrooge at the moment. I Geek, I'm hugely keeping my fingers crossed for you for Mon or Tues. Mum is due to complete on Monday next week and it's so nervewracking as you know the deadlines looming for those going on their Christmas hols - sols, banks etc!
Mum moved in with us yesterday. All her furniture is now in storage (had to put it all in yesterday as the place closes over Christmas for 2 weeks!). I feel for them being out of their home for Christmas, not a great time to be living in someone's spare room. Here's hoping they find a nice home in the New Year when hopefully more people put their houses up sale - she hasn't had much luck so far!0
