If she hasnt changed the wording on her auctions I would also be tempted to file a "not recieved" claim. However, when Paypal find in your favour and refund you send her the payment for the item, plus "fair" postage in line with what she actually paid.

    May make her think twice.

There is an option in Paypal to dispute the postage, use that. You paid for a service you didn't receive so you have every right.

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

Same here, I have never come across a paypal dispute for wrong postage, if this is a new feature I'd love a link as I'll add it to the FAQ.

    just did a test

got this before getting to dispute

    hdr_CS_750x180.gif

after these were the options i got
    I'm opening this dispute because:
    I haven't received my item.
I received my item, but it is significantly not as described. For example:
The item was damaged or defective.
    The box was empty.
    The order was incomplete.

then on the next page selecting SNAD
How was the item significantly not as described?
    Damaged
    Externally damaged

    For example:
Scratched, cracked, chipped, ripped or dented
    Stained
    Internally damaged

    For example:
    Power doesn't turn on
    Doesn't function properly
    Fake
    Copy of original

    For example:
    Bootleg or pirated copy
    Photocopy
    Imitation

    For example:
    Counterfeit handbag, clothing, watch
    Incomplete
Missing parts that prevent item from being used

    For example:
    Missing computer processor or motor
    Missing quantity

    For example:
You ordered 12 units but received 6
    Other
    Postage cost issues
    VAT issues
    Materially Different
    Entirely different item

    For example:
You ordered a book but received a brick
    Different design or material
    Different model, version, or size

    For example:
    Incompatible operating system
    Motorcycle engine v. automobile engine
    Shoes too small to wear
    Less valuable substitute
    Significant colour difference
    Slight colour difference
    Used when described as new

    For example:
Original listing said it was 'new' or 'mint'
    Unusable
    Ruined food or plants

    For example:
    Spoiled food
    Dead or wilted plant
    Time-sensitive item arrived late

    For example:
    Concert ticket

i stopped here as i have no issue with the seller :o
  • I'd definitely file a dispute as above poster suggested disputing postage. If she's made a mistake in her wording then that's her fault not yours. Once the dispute is over then leave the relevant feedback.

Just tried to register my dispute with paypal over the postage and this is the message I got:
Thank you for registering your complaint about this transaction. Unfortunately, this type of transaction is not eligible for PayPal dispute resolution. We encourage you to continue to work directly with your seller, as we have found that many misunderstandings reach amicable solutions through communication.

Does anyone know if there is any other way to get my money back?

Strangly enough it will let me escilate it to a claim though which I'm ok about as the seller made it very clear they weren't going to be refunding me the excessive postage charges of their own free will.

Edit: It seems to have closed the case down straight away stating:
We're unable to decide this claim in your favour at this time. PayPal's Buyer Complaint Policy applies to the delivery of goods but not to disputes about merchandise quality.

Will ebay let you register a dispute on there instead?? When is the concert?? If it's really close you could tell the seller you are returning them and open a dispute for 'items not as described'. She may decide to pay back the postage rather than receive the tickets back after/or close to the concert and not have time to sell them again.

My claim isn't tickets it was for a bit of clothing (if you see the last page I tell my story there).
Because I paid with paypal it doesn't seem to want to let me claim through ebay annoyingly!
