I think what you need to do hana is to write to head office in glasgow. Detail what you've written in your posts and make a point of telling them that you feel the call centre lied to your boyfriend in order to make him miss the cutoff point.
Tell them you have a recording of the voicemail that promises the cancellation and that you will be willing to provide a copy if necessary.
While i'm no legal expert, I would hazard a guess that as long as you keep that voicemail, three haven't got a leg to stand on.

Having read about Bossworld's friends experience, I'm definately going to follow your advice and write in. We've copied the voicemail onto the computer so they can have as many copies as they like! It clearly says that 'as they can't get through to (my boyfriend) - they will just go ahead with the cancellation'. So technically, they should have done it by now. I'll be interested to see what excuse the guy comes up with to explain why he hasnt now I've finally got someone to put me directly in touch with him again. They'll proabably claim that as the voicemail does not specifically state they would process a cancellation without an early termination fee, that this means they never agreed to it.
It's got past the point of not wanting to waste money now, I'm just so incensed that a company can somehow get away with treating people like this, and unless I spend hours of my time, and money, on phoning, writing or taking them to court, I can't do anything about it - how on earth is that justified when the whole thing is their fault?!! Something ought to be done about it - its all very well having an obudsman and trading standards but whats the point when you have to go through absolute hell before they'll even consider stepping in, and even then, it could take months to sort out. And the company is allowed to record/(or not record down!) whatever they like regarding the case, but if we record a conversation with one of their staff, it is discounted as evidence as they havent given permission to be recorded. The complaints procedure is so much still in favour of the company that they're able to just rely on people not having the time and energy to pursue anything. It's not right.0 -
I am still in dispute with 3 regarding the 3 Like Home removal.
After 4 letters and 3 lengthy phonecalls, they eventually offered £30 goodwill gesture, which i refused, and wrote another letter to head office. However they have replied saying that it was a promotion (which is wasnt when i took out my contract) and that I am unable to cancel...
So i have wrote another letter to them explaining all this along with my disgust at the way the company has dealt with my complaint! will let you all know when I get a reply!0 -
Just to add for anyone that's interested, I rang up Three today regarding the final amount that I owed them, but hadn't been taken as they'd cancelled the Direct Debit.
He said that the money was still outstanding, he could tell that the DD had been cancelled but the cheeky sod tried to say it was me that had done it. Anyway just said that I wanted to settle it and have done, so he took payment by Mastercard and that's all sorted now.0 -

Good luck to him it expires 09/09, it's a student one with a £500 limit (which I'm currently living out of) and only the £9.06 has been taken out so far. Same with the unlocking fee I paid last month, or should I just assume the worst in people like you seem to do?0 -

I would of made the same comment if it was a English call representative in Warrington, (giving your CC details and CSV over the phone) sad that people like you have to call a racism card whenever anyone makes a comment which involves a religion or race.

They tried to convince me they had texted everyone but i told them i had read hundreds of posts on here from other people who hadnt received one....
And yet when I called to cancel, they said they could not do so as I had not been sent the text and that only those sent the text were entitled to cancel! They will say anything they need to, whether it is the truth or not.
I am so glad to be shot of '3' - I can understand a company not wanting to lose customers but they are agressive and downright dishonest. I would never recommend them to anyone, regardless of how cheap they are.

Gosh I'm so glad I got out of mine successfully a couple of months ago now. Hana, you said that any recordings you made are discounted as they did not give consent. Correct me if I'm wrong but doesn't the machine say before you're connected: 'Calls MAY be recorded for [whatever purposes]' I'm pretty sure that counts as giving consent for recordings, EITHER way. The statement, although they intend it to mean 'we will record the call', can equally be interpreted as 'you may record the call'.0

I recieved the text on both of my 3 accounts. I used both accounts in Australia and Austria and this would have cost me significantly more money.
I phoned to cancel and after 2 hours on the phone I managed to cancel both accounts. During one of them the computer crashed and caused a lot of problems.
3 were due to give us a refund and we left the DD up and running to get the refund.
Imagine my surprise this month when I find that 3 have taken a £75 cancellation fee.
When I called they informed me that it was for canceling. I explained that both accounts were cancelled and that there was supposed to be no cancellation fee and this was all agreed.
One phone had the fee charged but not the other. I explained about the text offering me to cancel and they told me I would have to ring back tomorrow when cancelations were open and speak to them.
I really thought I was shot of this useless company after so many years, alas they still plauge me...
I just want my money back Grrrrrrrrrrrrrrrrrrr0
