If you use "3 like home" read this- possible reason to cancel??

    This is the first minute billing fiasco all over again, as I've said to others before. Personally I think you're right, but will they listen/do anything? And then, if you go to OTELO with it, will they do anything? No. I hope you get somewhere, and wish you the best with it, as I've tried a similar thing before and failed, but I doubt you will.
    Like the first minute billing thing, this has suddenly changed into a 'promotional deal.'
    And a notification on the website most certainly counts as a notification of existing customers, as this was part of the argument used AGAINST me when I was dealing with the first minute billing thing.
    I'm not even bothering this time as my contract's up soon.

    If you request a PAC code, It'll add an ETF to your bill, If you try and sue 3, Then the legal team will probably take you apart in court.

    Yes, I would be very careful about suing them. Try OTELO first.

    And taken from the 3 at home Terms and Conditions:

    "3 reserves the right to add or remove participating networks and may suspend, amend or withdraw this promotion at any time."

    I think you are correct DrBob.

    Stick to your guns. Just because 3 are a large company this does not mean that their legal team will 'rip you apart'.

    You have more than adequately stated your case in the above posts and pointed to the terms of the agreement (Unless there are separate clauses that you have not mentioned).

    Keep going and dont give up.

    Even though it states in the T+C's they can withdraw, change, suspend it at anytime?

    Are those the terms and conditions that applied to 3 at Home at the time?

    If the 3 at home 'promotion' (this is disputed as some say when it was introduced it was not a promotion) induced you into entering the agreement then you have an argument to give notice and end the contract.

    If it was not detailed as a promotion it is part of your price plan in the same way minutes and anything else is.

    One route always worth going down is Watchdog.

    It is worth remembering in law there is no black or white, just lots of grey areas.

    I doubt they would just change the T+C's for the sake of it. Its there plain and clear, They also advise in the T+C's "We will try to give you advance warning of any changes although this may not always be possible."

    As I said before, I believe they've changed the website to call it a promotion after I signed up. Here's a copy of the 3 price guide from June 08, it lists 3 like home alongside all the other roaming services, no mention of it being a promotion or time limited.

    One problem for me is I don't know exactly when 3 made the change to calling 3 like home a promotion in the terms. I only noticed when they announced the withdrawal of the service. Changing 3 like home to a promotional time limited service may itself count as a detrimental variation of the the contract. Since it's possible I didn't complain within 30 days of that change. I might be scuppered. Going to wait for their reply to my second letter.

    I really wish I'd saved a copy of the three like home web page and terms when I signed up in June 08. Without it it may be difficult to prove my case if should this end up in court. If anyone has a copy of that web page from June 08 or earlier, it would be really helpful in establishing whether I have a good case or not.

    True, I will probably try that first. However the small claims court really isn't something to be scared of if your case is solid. A couple of years ago I successfully sued Carphone warehouse over a cashback deal, big corporations don't always win.

    You wont win because they have done nothing wrong - and you have no evidence whatsoever that they have done anything wrong. I suspect your case with CPH was different as it involved cashback which I assume would have been documented.
