  • You can claim from July 2001 until present. The issue with financial hardship is that the account you are claiming on has charges today and that your financial hardship is today which means if the account is closed or unused in the previous 6 months then it is more difficult to prove financial hardship on.

    I am still using the bank account, my issue was, by going down this route - the bank can't close my account or request my overdraft back early can they? I have £2000 overdraft and £500 credit card... buy requesting my bank charges they cant ask for that back can they?

  • I was wondering if it was too late NOW to start a claim for charges? I have been ok not particularly going overdrawn etc until becoming unemployed in April 2009. Eventually I have found myself in bother, with my latest Job seekers allowance payment of 120 (for two weeks) about to be swalloed up by 105 worth of charges for two direct debits not being paid and an overdrawl charge. I am beside myself with worry, as I see no way out

    They shouldn't request the overdraft back early and they have no right to lose you the credit card(was it a former Graduate account? Recognise the amount on the overdraft and credit card limit ;) ).

    the basic answer is yes absolutely.
    The next question is do you have priority debt arrears(mortgage/rent, council tax, utilities)?

  • Hi Natweststaffmember- the account has been opened since for at least 4 years previous to that, i'm not sure of the exact date i opened the account but i know it was before my daughter was born in august 03. Have called them and said i wanted just the list of bank charges, and have paid £10 already. The woman i spoke to said they might not go bck that far, which i didn't believe and told her so, then she had put in a request so hopefully will get them soon. Some banks try anything to delay things!

    They do go that far back since the FSA reminded all firms of their obligations under the FSA Waiver on Bank Charges in March this year. On my signature is the waiver, and under 13.5 it is about data retention(statement details) which they have to keep. Ask them again and tell them that if they will not provide the information you will complain that they are breaching the FSA Waiver on Bank charges.

  • hi i recently got a list of all my charges from the halifax i sent them a letter requesting that they repay me the charges as i am in financial hardship. today i got a reply to say that they will look into my situation and will come back to me within 4 weeks, i was expecting them to send me something to fill in with all my outgoings but they havent. has anyone else had this and do you think they might repay me?
  • Hi i was wondering if anyone can advise me, i am in the process of reclaiming charges with Rbs under financial hardship, and recently filled in an expenditure form they sent to me. I got a letter today saying that my customer financial statement i returned had now been forwarded to a different department (Collections Centre in Glasgow) and that department now wants documentary evidence of my Rent, Council Tax, Gas, Electric, Fares, Motoring and Loan amounts and to confirm how many people there are in my household. Is this normal as i have already written details down on the Financial statement form? And also my loan isn't from an actual loans company of such, it was from my step dad to buy furniture which he paid for and i pay him back at £40 per month, would it be accepted to include a covering letter from him detailing this? :confused:

    You need to send proof of arrears to them.
