Well, I started my claim with RBS in 2007 and was put on hold like everyone else...few weeks ago thanks to this forum I found out about the hardship thing...so off my letters went as we have mortgage, c/tax and utility arrears...my charges totalled around £1900 and so with interest I put a claim in for around £2400...2 weeks ago i recieved my incomeand expenditure form filled it in and sent it back along with proof of my predicament...got a letter last week aknowledging the form andsaying they were reviewing my claim...then a letter on Saturday saying that they have come to an agreed amount to offer me and i will recieve my offer in a separate letter :T....so now its more waiting, hope its not too long though0 -

I've taken the day off work to get myself sorted, I couldn't have coped with going in anyway knowing I have lots of personal stuff hanging over my head!0 -

Amount Received: £2600
Length of time: June - September (approx 3 months start-to-finish)
I received a call today from our Case Handler stating that he had investigated our financial hardship claim and agreed to give us a total of £2600 back. This amount will be split between two accounts and will bring us out of our overdraft and provides us with a little financial respite. It isn't as much as I had hoped, but I am still delighted, as it will help us with our rent & utility arrears and it is better than a poke in the eye with a blunt stick!!
I know that we will be entitled to the rest should the test case go in favour of the consumers and not the banks - fingers crossed on that one!!

The letter i received says my request has been assessed and confirmed subject to regular token repayments as appropriate. This arrangement can continue if required until the result of the OFT and UK Banks court case outcome is known.
Until the result of the charges test case is known we can confirm that no further charges or interest will be applied to your account.
I can confirm that today I ordered new cashcards for yor account.
In accordance with these arrangements please now return all the servicecards that you have in your possession.
A refund of the charges has been agreed. Upon receipt of the active servicecards an offer letter will be sent from our Customer Response Unit in Edinburgh confirming the amount.
This can take up to 21 days.
Please could you clarify what the repayments are and what card am i likely to get, I am currently unemplyed and my bills are escalating.
I look forward to your reply

I thought it would be a standard letter that i received!!
I await their letter from Edinburgh!! Very sceptical about it all tho, I have had months of this, not been happy with the adjudicator assigned to my case at FSA. Communication has been very poor to say the least.

Time frame of claim:3 months roughly.
Accepted the offer as if I turned down their goodwill offer I would of had to wait for the test case to end.
This way I was sent a cheque as my account had closed 3 years ago.

Can I take the opportunity to ask about my previous claim with the Halifax?! Both Halifax and the FOS said that we weren't in financial hardship, which to a degree we aren't but I am now in contact with CCCS to decide what is the best way forward with our debt and they have said that our water and electricity on my rented property (bills accrued while I lived there) and the electricity on our current property are in arrears and these are classed as priority detbts?! Should I inform Halifax and ask them to reconsider?

Hi all,
I started the process of reclaiming bank charges from NatWest about 3 months ago. The total came to about £1700 over two accounts. They sent me the I&E forms, which I filled in and sent off along with all of the supporting evidence. So far so good I was thinking after looking on this site.
I have rent arrears of nearly £700 (got an eviction notice from the council which I sent off to the bank), council tax arrears of £300, outstanding water charges of £500, and over £2000 of non-priority debts, on top of which I have a £4000 loan with NatWest which costs £105 to pay off each month. My income/month is £585 which barely covers my usual outgoings, let along paying off any of these debts.
I got a letter back from them saying that they did not consider me to be in financial hardship because I had had a loan facility agreed within the last 6 months. What this really was; I had a loan out with NatWest to pay back my student overdraft which had been agreed in 2007, but I had defaulted on my payments and owed £280 on it. At the time I had just just started a new temp job, and they froze my accounts so I was unable to access the money from this. I phoned the bank and they basically said if I did not take out a consolidation loan, they wouldn't unfreeze my account and would take me to court for the oustanding loan arrears. In my mind, that meant I had no choice but to accept this new higher loan agreement, which they said would not require a credit check, or that I would be able to keep up repayments. As I explained to the guy on the phone, I was working in a temporary job that was only due to last 8 weeks tops, as it happened, it only lasted 4 weeks.
Please can somebody help?! I phoned the 'Direct Dial' number on the letter I received and got through to a woman who basically said she had no idea how decisions were made, no idea about my case (even after asking for my reference) and no way of helping me whatsoever.
Am I in financial hardship from the information I've given? I will have to default on my loan payment this month as my regular bills have been backing up and I now owe electric and have had my phone cut off. Any help would be very much appreciated.
