    sorry to ask but i wondered if anyone could offer me advice on my situation, especially if they have had a similar situation.

    i put a bank charge claim in a couple of years ago with HSBC for around £3k. It has been put on hold whilst the banks court case goes through.

    i have since split up with my girlfriend and ended up on an IVA (debts run up whilst in that relationship). I am managing to pay all my bills at present (not with the greatest of ease) but wondered if i could/should get my bank charge file reopened under the financial hardship thing.

    Is it likely to help my case as i am on an IVA, or will they see it as i am paying what i can afford and therefore am not under "financial hardship"?

    I was wanting to use this money to see if i can end my IVA early.

    Thanks to Martin Lewis MSE, I have successfully claimed bank charges under financial hardship from Abbey. I filled in the template letter online and sent it off. I was asked by Abbey to complete a financial expenditure form with any supporting evidence of hardship. After a few weeks I got a letter from them saying they would refund my bank charges over the last six years. I am thrilled to bits!! This money has helped to pay some urgent bills.

    As above I claimed bank charges from Barclays recently and they have paid £375 into my account as a 'goodwill gesture'. I was claiming £250 for one account I have with them. However, they have not provided me with a list of all past overdraft charges on my current account which was previously a Woolwich account. For some reason Barclays have offered this sum of money for both accounts which is not acceptable. So I have written to them acknowledging receipt of the money but stating that this is only a partial settlement, not full or final settlement and I intend to continue my claim including going to the FOS. Wish me luck folks. I will keep you posted.

    Congratulation on the first part of the post. The second bit re Woolwich to Barclays is one that is interesting to me. With regards to them, what basis have you gone to the FOS(just so I am clear as to the reason why since not paying out 100% is not a valid reason)?

So I am waiting for their response on the matter before going to FOS.

    I am after a bit of advice I have gone down the Financial hardship route, filled in my expenditure form and sent information with my debt arrears, Have just had a letter from Natwest today asking for me to return my cards as they have issued me new ones! and have organised a repayment for my debts. My case has been agreed and i will be contacted by Head office in glasgow for the final settlement figure!
    I am sceptical about this because i do not know what this repayment is and how much they are offering.
    Any advice would be gratefully appreciated.

    When you send the cards back they will send you a letter with an offer and we can work on that. Can you type out the full text of the letter taking out your personal details.

    I got the info, you need to go into your branch and ask the person to look in their customer system/Customer Gateway and do a search under the heading of "migrated Account Enquiry" and they will be able to provide the details to you of the account.
