no i haven't redone one my income is still the same and expenditure cant change as income is the same the only change is the increase on my mortgage arrears. Is it worth sending another to lloyds and one to the fos when i respond to the fos letter disagreeing with their decision?

I think you need to re look at the income and expenditure form, because if it hasn't changed then how come there was no charges in July from LloydsTSB?
Something has changed in July(for the better, it would seem) but were the charges exactly the same amount since February?

Can you see why I said to re do the I&E form?

You have negotiated lower payments to other debtors so that means income is increased or that should be the theory.

That is the only way of appealing the FOS decision which is that your hardship has got worse rather than stayed the same. If we can't make it worse then that is where we have the problem arguing the case with the FOS.

it is getting worse as i incur 500 pound a month arrears on my mortgage,i will probably at some stage loose my home,i always have to rob peter to pay paul. And the fos have already stated"if you are having difficulty paying partiesother than the bankit is,i think, for you to approach those parties to see what they can do to assist.i do not think, though, that it would be right for us to uphold your complaint about bank charges because you are having trouble paying debts owed to other parties." their words exactly:confused:

Just like to say a big thanks to Martin and also to everyone else who has posted on this site. Started Financial Hardship claim in Feb 2009. Rejected. Then received a Court Summons for Factors Bills arrears, Financial Harship then accepted and above amount paid into my account within 2 weeks. Had ro return Highline card in exchange for Cashline card. Paid off my overdraft of £400 (although strangely they haven't closed my overdraft facility, But I have! Still got a bit to go before I'm debt free but this has definitely helped.
Keep fightin on everyone and Good Luck!

  • Bank: Abbey
    Amount Reclaimed: 8205.00
    Amount they paid: 7490.54
How long did it take: 2 weeks

I initially started this claim about a year ago via the standard claim application route and was given the standard awaiting test case results letter.

Upon notification of the hardship route I summed up my circumstances and realised I made this category. Basically sine the Abbey called my overdraft some 18 months ago and started this spiral of debt I had one thing after another go wrong including losing my joband various things indoors which I had no house insurance for. As such this lead to me sent eviction letters from the mortgage company which I gladly forwarded to Abbey and it took less than two weeks from when they received my supporting information to pay out this week.

If you are going down the hardship route it is better to supply more than just a financial breakdown, also supply other letters of debt that maybe you haven't considered, it all helps support your application.

So far in the last three months my pay outs have been:

    Vanquis Card £110
    Capital One £440
    Barclaycard £1064
    Abbey £ 7490

and I am yet to claim back the payment protection on these accounts too.

    Thanks MSE!!
  • im wondering if anyone has any advice,

i recently sent off my list of charges to lloyds asking for them to refund them back to me,a total of 3800 pound, anyway i got a response from them this morning in the post, but not the response i was hoping for as i am in financial hardship, it said the following-
thank you for contacting us recently,my complaint is being looked into by a lloyds team member and they expect to complete their enquiries and provide me with an answer within the next four weeks.

has anyone else received a letter like this and if so what was their
    outcome after four weeks.
does anyone have any suggestions what to do now, do i wait for them to get back to me or do i do another letter getting back to them saying for them to sort it out asap and refund me the full amount?? please help.

I hate these types of responses from banks. My opinion is to send them a letter with an income and expenditure(household) and notices of any arrears. I would wait but if they left a phone number then ring them every single day asking if they have made a decision
