  • Hi Thirftkitten, I have put a hardship case to Lloyds at the beginning of July 09 and they have tried to fob me off with they are really sorry and they are putting it on hold. They also do not send out a income and expediture form when asked and try to use delay tatics so I have got a copy of one myself and sent it to them. I have also phoned them on numerous occasions to point out my hardship and explain the FSA rules, please could you tell me why they refunded you, what was the reason they have paid so quickly. I am still trying and will keep ringing them.

    Thank you

thats what i dont understand lloyds tsb agree and acknowledge that i am in financial hardship, but will not issue me with a final response until after the conclusion of the test case and the fos seem to agree they have done all they need to do at this point, but as i understood it they are breaking the rules of the waiver:mad:
I'll have to go back one step again then. Do you have priority debt arrears(mortgage./rent, council tax, utilities)?
Are any of the arrears being paid off?
I have not worked for NatWest Bank since February 2009

Yes I have mortgage arrears and i have sent them proof of this and my IVA, I have two small children who I support on my own. Some people have had refunds from Lloyds and I consider myself a hardship case.

Are the mortgage arrears being paid off?

There are a lot of people who consider themselves in financial hardship otherwise they wouldn't be on the forum, the question is to work out whether the bank, under the FSA Waiver on bank charges should think the same. So the reason I ask is that a rough guide is that a lifestyle change occurred causing a loss of income which meant that the charges made the situation even worse.

  • I am a single parent and used to get csa payments this has now dramtically reduved due to ex partner having a new baby, my oldest also is starting secondary school and will need new uniform etc, with all of this going on I am constantly worried about money and have filled the income/expediture form in and it shows I have minus income left after everything is taken out, I consider this hardship.

What I am trying to do is to find out how LloydsTSB have made their decision and whether there is room to argue the case.
At the moment we have drop in CSA payments(which is not good but good with regards for financial hardship). We have priority debts to a degree but am not sure if arrears are being paid off(which would go against you) plus the IVA covers other payments which should have reduced outgoings. If LloydsTSB have said no then we want a financial hardship closure letter which should state a reason for their refusal to deal with the case as financial hardship.
