    I hope you can see from the last few posts that basically the way to argue financial hardship is that a lifestyle issue causes a loss of income which then causes charges which leads to arrears that are not being paid back because of the charges themselves.
    You need income and expenditure form(household), list of charges and letter explaining the above. Furthermore, if they say no then you need a financial hardship closure letter because it may be something that can be overturned through the FOS.

    they have had income expenditure form,list of charges,the fos have also had them aswell,but they insist they will not give me any response until after the test case and the fos seem to agree with them what else can i do?:confused::mad:
  • When did you first approach Lloyds?
    When did you last complete an income and expenditure form?
    Is there any room for manoevre on the I&E form?
    There isn't childminder costs, for example?

    i first approached about charges 2 years ago (when i was still in work)
    i then reapproached them in november 08 in relation to financial hardship as i was made redundant at the beginning of october.Isent them a I&E form at the end of nov 08 then again in feb 09.there is now room to manoevre as all we do is buy electric and food we have no money left for any other costs.

    Can I ask you whether you sent the Income and expenditure form from February 2009 to the FOS or did you send them an updated one?(Can you see where I am going with this one, now?)

    EDIT: are you incurring charges today ie since Feb 09?

    Not sure if you spotted the edit on the post but I'll ask but if you have answered ignore this post. Are you incurring charges today? or since Feb 09?

    Have you redone and income and expenditure form using the same basis in which you completed the other one?
    Is the bottom line figure different now(be it better or worse)?

    no i haven't redone one my income is still the same and expenditure cant change as income is the same the only change is the increase on my mortgage arrears.Is it worth sending another to lloyds and one to the fos when i respond to the fos letter disagreeing with their decision?
