    An employer always has the right to manage. As the owner of the company he has to ensure that he has proper cover for all the jobs that make up the company.

    As a self employed person if he doesn't work he doesn't get paid. The trouble is that "some people" have never worked for others and don't appreciate that they need a work / life balance.

    He appears to find you attractive, otherwise he wouldn't get jealous when others look at you. His wife probably doesn't appreciate his feelings.

    He has the right to decline specific dates for leave, for no reason at all, but you are entitled to 5.6 weeks paid leave (including Bank Holidays) per year which is accrued during your service http://www.berr.gov.uk/whatwedo/employment/holidays/

    Due to your short service he has the right to dismiss you for no reason at all.




    Personal opinion;
    He is a bully, of course, but NOTHING you or any other employee does will change that. Taking him to tribunal or reporting him to the "powers that be" may impact on his turn over but won't affect his attitude. But it may make you feel better.

    In short, the place isn't going to change. Ever.

    I have been in your place and GOT OUT. When I handed my notice in he said "You can't resign. YOU'RE %$£"* SACKED!". Suited me; went straight down and signed on! Jobcentre pointed out that he was the worst employer in town - like I hadn't noticed! - and waived the waiting period for JSA.

    Do yourself a favour. Walk! How long will they give you full pay for if you go sick? They are only obliged to give £75 / week Statutory Sick Pay. If you can get more then take it and get your GP to sign you off.

    The holiday is the crux of it.
    Whether they are bullies or not, you need to request holiday time before you book them. If they say no, they are well within their rights to do so.

    If you go anyway, its unauthorised leave and you will no doubt face the disciplinary consequences that go with it.

    If one of my employees came to me demanding holiday and not asked for the time off in advance, i would say no aswell. Its courtesy to do this.

    My advice would be to just get on with your job as best you can because there would a queue a mile long waiting to replace you.

    if i worked for you, and you told me i couldnt have my holidays out of spite, i would certainly never ever do over time for you and we would be on a bumpy road. you my friend would be cutting your nose off to spite your face

    Johnmc, I don't think I get paid any of my full wages for being off sick, I think its the standard SSP after 3 days off.
    If i'm entitled to days off yet he is allowed to refuse them anytime they're requested without reason - I'm never going to have time off because he can't get it covered?!
    In October last year I asked for a Friday in Feb off as was taking my partner away for his birthday, he let me have it but told me I couldn't have Friday's in future as they were "busy" days. Surely he doesn't have the right to dictate which days I can and cant have off, its ridiculous?!

    I couldn't put up with that. And on occasions I haven't put up with it. Small businesses are by far the worst, as it's like being in a school playground. They're so small and petty that it's utterly irritating.

    Right, what to do. Well forget about comeback and all that... Essentially it all comes down to having money and being able to survive. If you have a bit saved up then here's what I'd do...

    You're going on your holiday (but don't tell them that). You're working until a few days before you go on holiday (but don't tell them that). Really I'd just carry on going in knowing that it was only lip service just to get a bit more money out of the place.

    Also.. If you can manage it then get them to sack you. Then you can claim JSA afterwards, which you can't if you leave voluntarily. Getting the sack is quite easy. All you have to do is to wind them up a bit, they sound like the sort to blow their tops and wave their arms about. :D

    There are ALWAYS jobs out there. I've just been offered one in Toni & Guy, and I'm not even looking for a job. I'll be cutting the hair. :rolleyes: No, it's as an administrator/receptionist to keep the place running smoothly, as that's where their single problem lays which they want to separate from everything else. I'm not really interested unless it was worth my while, but I have no problems with getting things done. I don't even want the job anyway, so bullying doesn't work on me. I'd only be doing it for a bit of satisfaction. Anyone with delusions of grandeur who starts pushing me about I'd just put in their place, which is where this particular salon apparently has problems which it wants to get under control.

    And finally. It's not you. I've worked in these daft little places, and it's always worse when you have a family clique. They're all the same! Leave them to it! Forget about taking them to Court and all that, it's more stress than it's worth. And remember, they DO NOT own you!!

    So. You're going on holiday in June!! Congratulations ;) xx
  • Some people need to grow up.

    Ok it may be unpleasant but not everyone will have a good boss, you need to get on with it and do your job.

    Holiday entitlement is an entitlement, but that doesnt give you the right to dictate when you are taking it and you have no reason to feel aggrieved that your employers were annoyed at you trying to do so.

    Holiday is there to make sure that the employees are suitably refreshed and happy in their work. An unhappy employee is a bad employee. Most Managers automatically decline as a matter of course just to exert control. Which is where most of the problems stem from in the workplace. Managers are there to ensure the smooth running of the environment for which they are responsible, not to hinder it.

    The UK is renowned for it's poor management.

    OP. Go on your holiday. They DO NOT own you! You're there to fulfil a purpose and to do a reliable job, plain and simple. If they don't value you (and it sounds like they don't) then let them employ someone else. They'd sooner cut their nose off to spite their face, I'd put money on it. You don't need to be in that sort of environment. That's more damaging to you as your experience will be jaded.

    For a start, you are tellig the OP she is the best employee they are likely to get. No offence OP, but employing good people at the moment is very very easy.

    Regardless of whether her bosses are nice or nasty, doesnt disuade from the fact they are running a business.....not a charity.

    People cannot be allowed to just upsticks and take holidays without their bosses sanctioning it. If that was the case then business would be in a worse state than it is now.

    This scenario is SO simple a child could understand it!

    2. Book the holiday

    op. if i was you i would go on the sick a couple of weeks before your holiday with depression (if you can afford it) then when you come back off your hols say you feel refreshed and ready for work. that way i dont think your boss has a leg to stand on.

    p.s, im not sure of the correct laws etc, so if im wrong im sure someone will correct me shortly

    Yes my mum was in the wrong for extending a holiday I have already got the ok from my boss from without checking it with me first, but its done now and I just wanted to know if I had any rights, not come on here and be made to feel even worse.
