Employment matters are not within the remit of the General Dental Council, and it will take no action against him for this.
If you feel you have a case, employment tribunals are the way to go.
This will have no effect at all on his ability to practise.How to find a dentist.

3. Assess the helpfulness of the staff and the level of the facilities.

Just got an email, dismissing me for gross misconduct, I feel so relieved, I knew it was coming....!
Wonderful feeling isn't it, like a huge gigantic weight being lifted off your shoulders. I know how you feel. And aren't you glad now that you didn't leave. :cool:
You need to get down to the job centre and sign on ASAP. Like, do it today, or tomorrow morning. It's VERY important to do that. Mainly as they'll write to him etc. etc. and it adds an officialdom feeling to it all. Even if you're only going to claim for a month in-between jobs then do it. My bet is that he won't reply, ...and that causes your claim to be held up as the JC won't act without a reply from the previous employer. Which naturally, all adds to anything you might do in terms of unfair dismissal. You're counting on them NOT replying to the JC's enquiries out of spite... Small employers can be quite unprofessional, where as larger employers couldn't care less and just fill out the forms anyway. From what you've said in your previous posts I'm guessing that he won't fill out the forms or will just bin them, out of a 'personal' reaction to a 'professional' situation.
As for you removing details from the database as a result of a DPA request, that's fine. Like, I assume that he was actually employing you to do your job, and that they felt you were competent. ...or maybe they sought to undermine you...

Maybe so, but if you read back through the various threads relating to this matter there were various allegations of other unprofessional conduct by this dentist. If my memory serves me correctly this included using unqualified surgery assistants.
Like any post on here we have of course only heard one side of the story. However, if what we have been told is mainly true then some serious action needs to be taken.
25 years ago I had a dentist who could have been described by this thread! On my last visit he conducted a shouting match with his assistant across me in the chair!

What an idoit!!:mad: I would clear my name just for own personal peace of mind, but he cant give you a bad reference, although he can decline to give you a reference. I wish you all the best for the future and believe me you will feel ten times better when he is out of your hair!!:beer:

A bad reference can be given IF FACTUAL.
If someone is fired for theft, an ex-employer is allowed to state the person was fired for gross misconduct.0 -
To the OP, you said that you went to the CAB in January and they said you 'couldn't do anything until you had been there a year'. I don't understand that bit.
I may be wrong but I thought the rules changed about unfair dismissal a couple of years ago, so that you don't have to be in your job a year before you can pursue a claim?
Sorry if this has already been mentioned, if so I missed it. Worth going back to the CAB now I think, armed with all your info. Or even go directly to a local employment-law specialist Solicitor and ask for half an hour's appointment to discuss your situation. This shouldn't be too expensive - and some law firms even offer a free initial consultation I believe.
Even if you start another job quite soon, IMHO your case is still worth pursuing as unfair dismissal. Worth a bit of time and work on this, to avoid forever having an unchallenged 'gross misconduct' dismissal on your employment record...

I put my application in for JSA the day after I got my email from boss. Then the afternoon after I'd put it in I got an offer for ongoing temp work which I started yesterday, so have put claim on hold for now.
Still doing my appeal letter, just to clear my name as so unbelievably happy now i'm not working there

I'm going to go back to the CAB and update them and see what else they say, the only law I was aware that changed, was that because some employers purposefully dismissed employees just before they'd been in employment for a year, so they had no rights, the law is now more flexible in taking cases to tribunal if the employee hasn't been there a year.
Hope all that made some kind of sense :S lol

Have only caught up with developments and am sorry to hear that the outcome was as expected.
Personally I wouldn't expect the appeal hearing to overturn the decision - I went to mine knowing that it was a process that we had to go through for appearances sake.
Also I don't think you will have much luck with the employment tribunal, not being there for a year ......there are several reasons where you can go to an employment tribunal if you've been employed for less than a year but I can't find a link to them now - I would also give acas a ring.
Sometimes (especially as you've got another position) it might be better from a mental health point of view to let go.......2014 Target;
