DLA decision unsuccesful not sure what to do now

    I know Daska I'm terrible, I have already thought of that just waiting to see if they actually do say I have to have a medical then seeing if I can use the exemption for it but I have heard atos are pretty ruthless and I don't know if by me filling in the form already it might give them the right to insist I have one because I think on the form you have to sign to say you agree to the medical if they want you to have one, but I can ask and hope. I know I've got to try and relax about it because one minute I'm feeling happy that I have the award and can do some things I need to do with it and its a relief in a way because its going to help me but then I start panicing about the ib medical I know I cant go on worrying though as its going to make me ill.

    I eventually got through to income support who said my dla award was not in my records so they are going to email dla about it to get the details and he was nice enough to inform me my income support will go up a little bit too as I'm on hrc but the incapacity man actually fibbed to me earlier in the day as my dla award was not in my records when he said they were, I have no idea why he said that but that was the same man that told me it wasnt going to make a difference to my income support

    Lady K - sometimes the left hand does not knwo what the right hand is dealing with, sometimes they like to deal with their own little area and not cross over.
    As you have DLA, ur Income Support will go up, even if it takes a while it does get backdated and again it will get back dated to the original date in january. x

    "Healthcare professionals employed by Atos Healthcare provide medical services to the Department for Work and Pensions (DWP). Their main role is to give medical advice to help DWP decision makers reach an appropriate decision on entitlement to benefit." From the DWP website

    In other words. The DWP employ ATOS, not the other way around. IF... they request a medical and don't accept your exemption then get your local mp to question the DWP as to why ATOS are harassing you.

    Thankyou, I've just left things for today I'm trying to keep calm and just sit it out until I get the letter from Atos I just hope they will decide not to make me have a medical. I am hoping to have to avoid confrontation with atos about a medical because I will probably need to go the an esa medical with them once they migrate all over to that and I don't think anyone will be exempt then

    I have several physical things wrong with me that I put down on my DLA form and also the mentally related problems but I noticed today on the award decision letter that they really only focused on one of them to give me the award, probably because it was all that was needed and to add all the rest would just complicate things. For example they didnt mention my problems going out or the depression related problems I have and other things. It just stated that I could not walk more than 50 metres and the care I need from another person with various things. I do think the second dm did take it all into consideration though but just put it through as that.

    myself and my hubby are trying to sort a coffee morning meet and chat for anyone going through the dla appeal system to offer eachother support and a chance to talk to others who understand. maybe if others wish to do this in their area people can contact others in their area to sort this out.

    Congratulations Lady-k well done on getting your award. I just hope that i get a DLA decision through soon. . I don't get Incapacity Benefit(although thats what i applied for) i get the new one E.S.A (employment and support allowance) and im worried that if i get DLA would it effect my E.S.A. Oh well i will worry about that once decisions have been made, i think ive got a couple more weeks to wait yet until that happens.

    It looks like esa or incapacity are not affected by DLA. So long as I pass the ATOS renewal check I should keep my incapacity and it should be the same for you if you get DLA its just getting DLA in the first place that is the problem for most people

    So glad you got a good result Lady_K. I have twice been refused (have had ME/CFS for 15 yrs) and each time gone to tribunal and it's gone in my favour both times. Last time I applied for DLA I didn't get turned down so I'm thinking maybe you just have to persevere for a couple of goes, maybe so they know you are 'genuine' and hopefully after that they might leave me alone. I was told by peeps on the net to always but always appeal and this seems to be the case.

    Again, well done and now treat yourself to something nice and stop worrying.

    Thankyou Serena, I'm still getting used to it at the moment, will only be able to relax when the incapacity is sorted. It might sound strange but it feels so odd and I can't spend any of the back pay at the moment because having this support is something I'm not used to. I've read of people having their award changed taken away completely soon after it was given so I don't think I'll be able to feel secure with it unless I get passed for the incapacity
