DLA decision unsuccesful not sure what to do now

    I have been informed that any decision the appeal make will be dated from when you first make the claim so for me would be 10 months worth of backdated payments. very welcome if and when i do win the appeal.

    Blakespops, I think you mean for the DLA don't you? I know its a bit confusing as I'm waiting on an incapicity benefit renewal after filling in an ib50 form and the DLA reconsideration aswell. I just wondered if they may stop my payments for incapacity till they have decided if I will stay on it or not and if they do will they backdate it to when they stopped it if you know what I mean.

    i was told will be paid untill they turn you down. and any on going ones that you win will be back dated to first info in date.

    Lady_K I wish you all the best and do let us know how you get on when you get your decisions.
    Sorry that you are unable to get through to your CAB. I am a volunteer for CAB and we do a lot of DLA forms and challenge decisions too. It is true that it is hard to get through on the phone. The lines are very busy and also there is a lot of paperwork to do and a case record to write up on the computer for each call we take, so after a while we can't take any calls until we have caught up - sorry about that. And yes, we are getting a huge increase in people needing help with debts, repossessions, redundancy and claiming benefits , so CAB is extra busy. Our branch has just got extra funding to pay someone to answer the phones every afternoon so we have just extended our hours. I hope you are successful with your claim- keep trying.

    Its good to hear that there is some extra funding going into cab in some areas as its definitely needed at the moment. Keep up the good work, I know many people really appreaciate the work that cab do and couldnt do without it so Thankyou :)

    Do you think I should try and contact Atos about my incapacity ben form ib50, its only been 3 weeks since they had it back from me but I'm just concerned if anything went wrong like it gets refused and I don't get a letter so miss being able to appeal. I've heard it happened to others so am just worried. I'm actually more nervous and sick worrying and waiting for both the dla and incapacity than I thought I would be, constant stomach ache and alsorts

  • I get E.S.A (employment and support allowance). I have since january of this year, Ive also just sent of my dla form which took me ages to fill out. I already knew that it could be turned down and that i should appeal if necessary. Fingers crossed i don't. I was like many of you hiding my ailments and disablilties but it got to the stage where i just couldn't hide them any longer and had to act. I have severe back pain and it effects my legs which go funny when i walk. The physio and the dr i saw for my esa claim said it was nerves in my back causing it. I cannot stand for long and i cannot sit for long, i am always fidgeting etc. I now use a walking stick to walk because i have a tendency to trip/stumble and even fall. I fell down the stairs last year and only thought i hurt my ankle at the time but its been since then my back has got worse. My gp has not been really any help as he just passes me off to physiotherapists and give pain meds and leaves me to it. I had an x ray on my back in september last year and because of that x ray my doctor sees nothing wrong even though the x ray shows my spine is tilted to the left. I keep getting told to lose weight because that will help, yes it would if i was not on steroids for a kidney transplant i had 9 years ago. No matter what the decision the dla take i will continue to fight all the way if i have to.I know it is going to cause me so much stress by doing so but there is nothing to lose by going all the way. I have had help by friends of mine who claim dla so hopefully i will not be turned down. Lady-K do not give up, i believe it will be worth it in the end.

    The decision maker looking at my reconsideration rang me today, I was quite surprised but at the same time glad they are looking at it although I was told it wouldnt be reconsidered until 5th May and that I had until then to send in extra information. Its lucky I sent it last Friday by email and they have confirmed its in my file.

    He told me his name and sounded very nice really but you can't really be sure.
    He wanted to know more on my walking, getting up from a chair, if I can get in and out of bed myself and how many times I use the loo during day and night. I answered his questions and he said he was clearer on things now. He seemed quite concerned that I'm not getting more help from my gp. I feel quite nervous that he rang me, is it good or bad?

  • I asked for a reconsideration of dla in october, and the decision maker rang me last wednesday to ask me a few questions, she was really nice too, and asked me the same as what you were asked.
    Anyways, she said she would be making an award, just needed info to help her decided which one.
    I asked her at the end of the call if she knew what award i would get, and it's high rate mobility and mid rate care!
    Well pleased, and the letter came today confirming it, so I would hope it wont be long before you hear from them, now they have spoken to you on the phone.
