DLA decision unsuccesful not sure what to do now

    Link to Benefits and Work, get yourself on there. It costs £18.95 for a years membership which may seem a lot up front but it will explain how to put your case across.

    Hi daska and Lolababy, noitced you both used the benefits abd work website, I have to confess I only used the freebie parts of it, and found it excellent, sorry to be nosey, but do you get alot of info and help etc when u become a member.
    I know in the next 18mths or so, I'll get transferred from IS, and am hoping to get teh ETA, and they seem to mention that on their site.

    i joined in order to access the full dla guides, which i feel are well worth the cost of membership. they also have guides to esa claims as well. plus they have other info and news that is member only in their newsletter emails. i had not intended to extend my membership past the year because dont need it again for dla but i find the site so useful i have paid up again and will contiunue to do so.

    Hi purplecatlover. its really good to have the perspective of someone that has used the site, as I said b4 I just had the freebie bits, but had said that if my DLA renewal got turned down, I was going to join, but thankfully they renewed ir for another 2 years..... xx

    Ditto. It presents things in a straightforward way and explains what information the forms are looking for so you can give an accurate picture for the assessors. It gives additional information so that you can anticipate and forestall some problems. When I found out about something that might prejudice my claim I told my GP what it said and she (horrified) took steps to ensure that I wouldn't fall through a loophole for the sake of some paperwork. I'd thoroughly recommend it. I suffer from ME but I have twice been awarded HRM and MRC without any need to go through reconsideration or appeal and I'm convinced it was because we found this site. On the second application particularly so because my husband had to fill in the form and needed to understand how to describe my condition (I couldn't compose a logical sentence at that point, how things have changed!).

    I have thought about that site for a while but didnt join because other people were saying that the same info in on the net anyway by other means and the forum isnt as good as this one so I didnt bother, I thought if I hit problems I would rethink. I will give it a little while to see what comes out of this reconsideration then decide.

    I've been quite quiet today I just didnt feel like doing anything because I think I needed a bit of time off it for a while because for weeks now I've been looking things up, trawling these threads, filling in that dla form and taking weeks to do that then I had to do the ib50 form which took me a long time to get sorted and its so important I have got myself in a mess about it. I only just posted the ib50 form the day before the decision letter from dla came through the letterbox, crazy because the day before I posted the dla form the ib50 came through the door so its taken over for the last couple of months really. I just felt so fed up today and that whatever I did today wasnt going to change anything at the moment, I suppose I just thought its in the hands of the dla now and sod it because I felt helpless. All the time though I've been thinking bout the ib50 form because I checked the tracking number and they recieved it today so I've been thinking about that thinking what the hell am I going to do if they refuse that. I don't think I can cope with any tribuneral or even medical I'm praying to god they dont make me go to one. I did request a home medical on the ib50 form if they could possibly do it. I put on my form about my going out problems and of course mobility problems plus its about 10 miles away, I went into a lot of detail so if they want a medical after reading that knowing that I'm a virtual recluse and the problems I have with everything else on top I will have no faith in them because that is like putting me in a situation that they know I probably will not be able to make, I will think they have done it on purpose. I'm just convinced I'm going to fail the ib50 because I have to do if they are going to get a report from the gp as if I cant pass the dla form I'm not likely to pass the ib50

    Thankyou for that, I will have a look I havent looked at those before, the thing is although I know myself I have mental related issues on top of the other things I have I have never been diagnosed with anything because I dont go out to the doctors and even if I have ever had to I have never said anything about it apart from saying I have difficulty going out but she didnt want to know. I think because she doesnt care anyway and because she can say well I'm there in the surgery. I did end up in tears one time, the only time and was cut dead because she wasnt bothered in the slightest I dont even believe she put anything about that on my record but for me that was a massive move because its something I dont do. So after that I could never open myself up to her again ever. I know I have to change gps but I dont think its a good time right now as I'm in the middle of this but I'm looking into trying to move to my daughters doctor who is very good aparently so even though I would have to get a taxi there and back and my present gp is only 100 metres away I have tried this one for years now and I cant talk to her and she doesnt understand me so I have to move

    I looked more at the letter last night and it says in a lot of places that I can use appropriate aids and adaptions but I have explained clearly on the form that most of the adaptions and aids were taken back by the occupational health because they wouldnt fit. The toilet seat stands wouldnt fit in the space because there wasnt enough room plus a radiator is in the way upstairs and downstairs is too narrow to get it in and another radiator and pipes in the way. The kitchen perch they have me caused problems because my kitchen is so small and I kept falling over it because of other issues I have. The shower is over my bath and they couldnt put grab rails up because the walls are studded but it is a nightmare getting in there even with help and theres nothing to hold onto when I'm in it and I cant stand up for long at all. I even pulled the sink off the wall and collapsed on the floor with it on me because I have to hold onto it to get in, its the only thing there.

    I need help dressing and showering and some drying and other things, it says I do not need help with any of these things. They have also totaly ignored some of the care needs I stated.

    Says I'm not at risk of falling but I fall a lot and stated it.

    I need personal care they say I dont

    Plus the so called important enclosed leaflet that I must read was not in.

    I would suggest that you write a response to their decision, clearly stating where they are wrong or have ignored what you've told them. Bullet point it rather than write reams of explanation.

    e.g.
    toilet seat - equipment removed by OT as unsuitable.
    perching stoot - equipment removed by OT because it was a hazard

    If you can only manage with equipment but they can't supply it or have taken the equipment away then you can't manage.
