Esa Medicle exam Twisted everything i have said!!

i have just recived a letter with a copy of the report of the medicle and to say i am !!!!ed off is an understatement everything i have said has been twisted in a blatent attpempt to make it look like i can do things i cant.

"the client feels they would benifit from careers advice" ( at no time did i say this)
"the client would like to get back onta a mechinics course". (obv i would but im unble too due to my disability this is making it look like i want to and can do)

"the client feels there limb problem has no impact on their ability to interact with friends faminly attend appointments and cope in crowded places"!

!!!!!! i told the women how much hassel and pain it caused me to attend this interview! i also told them how its hard for me 2 visit friends and family due to my mobility needs what she has wrote makes me feel sick!

"the client says he would like to have some careers advice to help him find a new form of employment and perhaps go back to collage"

omg i did not say this at all. i said i would love to go back to collage and work obv i dont want to spend my whole life on benifits but i cant because of my disability shes obv disregarded the fact i said i dont feel i can work or go back to college because of my disabilty and just wrote down i would like too!

again !!!!!!! i told her i used to live indipendantly but i moved back in with my partents 2 years ago due to my disability and living on my own was difficult she said to me what about if you had 2 live on your own i said well id have no choice and i have to bare the pain. i cant belive she has wrote that.

the whole reports just appears like i have said i want to go back to work or collage rite now. there is very little mention of my disability the most anyoing thing is how its all been twisted all the points i made about how it effects me have been left out! im extremely !!!!ed off as i thought it went very well and the lady was friendly im not happy with this at all i cant belive some of the statements who can i speak to to complaine and get it looked at. this is ridiculous! :mad:

    Surely anyone who is not working (disabled or not) would benefit from career advice?! Disabilities differ and there are jobs out there. I can't understand why anyone would ever want to turn down careers advice, working or not.

    Then the statement is correct then isnt it. You want to go on a course, but can't because of your disability.

    If you feel like the rest of the report is inaccurate you need to let them know. These people are there to help you.

    yes careers advice can be helpful but my point is i told her i didnt feel at this time it would benifit me as attending places and my mobility needs make it very hard and under my current circumstances not a viable thing to do.

    ok here is a more detailed version of the report

    One other thing i noticed having got a copy of the report is that i wasnt asked the same questions that are on the report its self the doctor has made up their own questions to ask me then filled it in here are some examples

    "what do you feel would help you achieve your future plans in relation to work"

    the doctor has wrote

    " The client feels they would benifit from some careers advice"

    " the client would like go get back on a mechanics course"

    i was not asked that question but various other little silly questions to get the answer she wanted to hear from me! now if i had of been asked that question how it is asked on this form in front of me the answer would have been completley diffrent! i would have said . im considering having a hip replacement and looking into physiothearapy. can you not see how they are twisting/ trying to get you to say what they want?

    "what impact does your health have on your daily life"

    again i was not asked this! i was just asked a bunch of little questions like can you do house work, can you read and write use a computer?

    the answer she put is " the client feels their current health status has no impact on their ability to read speak wirte use a computer. !

    !!!!!! this is not fair! where is the statements i made about how it effects my mobility getting dressed in and out the bath etc! this is blatent twisting leaving out vital things!

    "do you recive any help or support fron other people with regard to your daily life?"

    again i was not asked this i was merely asked if could do house work and shopping etc and could i live by my self.

    she wrote down the client reports he could live indipendent but chooses not too!

    omfg i get help from my mother and my g/f with lots of activitces dressing me cooking my meals helping me gett around outside and inside where the hell is the chance for me to mention this i was not asked the questions how they are on here this is totoly unfair and misleading im discraced by this!
  • The thing about living independently - You DID say you would be able to (even if it was not your choice and you would have to bear the pain). You didn't say it would be impossible for you to live on your own and that you would always need a carer .

    I think they have written down what you actually said, not what you thought you said.

    However, I'm sure there is some form of appeal. Get in touch with the DWP.

    if i had no choice i would have to id woould walk 1000 miles to see me kids if i had to. so it dosent matter how much pain you are in as long as you can struggle and manage to do it thats ok :mad:

    I dont know what anyone else things but that is deffinatley misleading jox should have been asked the same questions and given the chance to fully explaine his problems. it appears as tho they have indeed asked you their own questions in an attempt to get an answer they are looking for. this is actualy quite shocking. jox get on the phone to them asap! im due for one of theese soon myself im not looking forward to this now

    It is important to note that these tests are subjective - not objective - they hope you are having a good day to disqualify you from entitlements.

    We are also dealing with people who use spin as much as Blair and Campbell.

    I wrote the following some years back - just after being disqualified from benefits for not getting better after operations went wrong at Papworth (documentary proof of this available):
    First a warning for those on Incapacity Benefit. When you fall ill, you expect the State to help until you can get back to work. I was not claiming all entitlements, just enough to get by - until I recovered from these ops. My Doctor and the Company Doctor advised me to do part-time therapeutic work. If you do any other work while ill you may be considered a fraud.

    I have written proof that the Benefit Agency deny your right to legal entitlement - if you try to go back to work and fail to get better. Below is a scan of prejudiced evidence they used against me.

    I did not get better - this was used against me, to stop my families legal entitlement to benefit. I was later to find out the rules allow them to use opinion against you (in legal action). This is against the old and sick - something that the police can not do with known rapists or child molesters. Yet they ignore the rules that help you - like the one that says they have to reply to any questions. Indeed, when I questioned their decision, they effectively tried to fine me £858 for doing so. You would not believe all what I found. The Benefit Agency even have rules to make you rob money from your children before allowing you benefit.

    Perhaps worse of all, they have rigged the 'all work test' - used to disqualify sick and disabled people from benefit. Proof is with Social Security Commissioners File:CIB 5361/97. Mr PL Howell QC, on 20 May 98, said 'There are obviously some disturbing implications...' This abuse has been closed - but it does not close the reason behind it. By scrutinizing the figures and looking at trends, you can work out their true intent. My findings, analyzing Hansard figures, were a lot more disturbing than that discovered by Mr PL Howell QC. But enough of that - for now.

    The OP has not said whether they have failed to medical or not. The exam is for ESA and not for IB.

    for a start the answer she wrote is not evern how it has an impact on my life she has only put what it dosent have an impact on.

    are you telling me its rite of her 2 totaly disragard the help i have getting in and out of bed using the toilet getting in and out of the bath dressing myself cooking for my self?

    i serioosly cany belive people think this is acceptable its clearley intentionaly missing out vital points. it seems people on here have the same mentality when it comes to disabled people this makes me sick

    i havent failed the exam or passed yet i have just had the report. but im not happy with it at all its !!!!ing disgusting. someone tell me who i need to contact about this its a total discrase i want to make a complaint about this nurse and take this as far as i can. :mad:
