  • Can anyone say if the Banks in Scotland are also repaying charges most cases seem to refer to English cases, if they are not is there a system for reclaiming in Scotland that can be followed to the same degree of success.
  • Hi i am new here and need to ask a question regarding bank charges, since january this year my bank has charged me 1658.00 these are made up of overdraft interest, overdraft excess fees and account charges, am i able to claim all these charges back, including the interest?

    Wilf, sign on to https://www.consumeractiongroup.co.uk, and check other peoples' threads on the relevant forum. Each bank is behaving differently, and I can't really tell you much more at this point. You may well find out that some people have been successful in getting the info in different ways.

    No unleashing at all... Just a few comments.

    You seem to be under the impression that the banks are our moral guardians. They're not.
    The law very clearly states that penalty charges are unlawful. I'll rephrase it so that there are no doubts: They are not allowed to penalise us for our trespasses. That's it, that's the law, starting as far back as 1896.
    The law further states they are not allowed to make a profit from our breaches, only to recoup their costs. That is also enshrined in Common Law.

    You see, your comments miss out on the most basic fact of all: If the bank didn't want us to go over the limit, they wouldn't let us. All they have to do is systematically refuse to pay out if if takes you over the limit. You talk about deterrent? Well, how quickly do you think people would learn not to try and pay with money they didn't have, if they knew the payment would get refused? Very quickly indeed, that's the answer. Amazingly quickly, in fact.
    You talk of taking without asking, but of course, that is not true at all. Every time you present your card for payment, you ask for it to go through. Every time the payment goes through, the bank has effectively given permission. They don't have to. They choose to, and then whack great big amounts to punish you for it.

    I won't bother to comment on the last "probably avoidable" sentence. Read a bit more around this forum, around the ConsumerActionGroup forum, watch the Trevor McDonald programme this monday coming, and if you are as sensible as your post seems to indicate, I hope you will soon realise how mistaken that last sentence was. If not, ask me, and I'll tell you how I personally got dragged further and further down by bank charges through no fault of my own.

    Yes, they are.

    The Court system is a bit different in Scotland. But the procedure to start with is the same.

    Excess fees, definitely.

    o/d interest, only the portion of interest that is accrued from bank charges, not the interest that stems fron YOUR use of the o/d, if you follow me. Of course, if the o/d is due solely to charges, then the lot can be reclaimed.

    Can you clarify what you mean by "account charges"?

    Hello i am new to the forum, i read this site with regards to bank charges and went ahead and tried to claim back from my bank. The overall charges from 2 and a half years ago came to just over £1600. These charges were from going over overdraft and not being able to honour cheques some of small amounts and some of larger £99.00. Is it possible to claim all charges back? They have put £400.00 back into my account. I need to know if i should pursue it further. Help would be much appreciated.

    Which bank? And how much is the charge? Do they charge it whether you go over your limit or not?
    The clue will probably be in the amount they charge. Let me know.
