Yes, unless they told you in one of the sod-off letters to send them off elsewhere. (some do, as they have so many claims, lol) It will soon get passed on to their legal dept.0 -

Barclaycard are a pain in the butt, they are playing fast and loose with the Data Protection Act, and are a perfect examples why punitive damages should be applied to thi skind of behaviour.
£10, yes, it is legal, and it is the maximum they can charge you under the DPA. However, B/Card have been trying to hang on to their, sorry, YOUR information, as they very well know what you want it for.
Find below the letter I have sent them, feel free to use part or all of it:You have stated that statements prior to June 2004 are manually stored on microfiche and do not fall within the Data Subject Access provisions. Section 1 (1) of the Data Protection Act 1998 states:
"any set of information relating to individuals to the extent that, although the information is not processed by means of equipment operating automatically in response to instructions given for that purpose, the set is structured either by reference to the individual or to criteria relating to individuals, in such a way that specific information relating to a particular individual is readily accessible".
Furthermore, recent communication with the Information Commissioner’s office has brought further clarification:
“(…) if the information is filed by account number this information would be considered to form part of a relevant filing system as it would be similar to searching a computer data base for a specific account number.”
Since you have informed me that I can obtain additional copy statements from your Customer Services, there can be no doubt that the information IS readily accessible, IS filed in a relevant filing system, and therefore DOES fall within DSA provisions.
Please find enclosed my payment of £10 for the information. You have 40 days to comply with my request.

You file through your local court with an N1 form. Same procedure,it's just you can't file online for Scottish claims.0 -

Hi all,
Afetr sending off my request for last 6 years charges & £20 (for two accounts) to First Direct I ot a letter back today returning my cheque and saying they will give me my last 6 years statements for free and they will be with me shortly. All sounds ok but just wanted to check, by returning my cheque they are not jumping thru any loopholes are they?? any advice appreciated.
Also about 4 years ago I had an MBNA card which I forgot to pay a fair few number of times I think the original balance was about £80 then though unpaid charges it crept up to about £300, I have been paying off about £15 regularly but recently missed some more payments. Does anyone reckon I can claim these back?

Dont worry, this is par for the course with First Direct - I got my DPA request free, I think most people on CAG did as well, many who have already got their money backFD do seem to be one of the "better" banks if such a thing exists! I sent my first request for repayment letter on Monday and got the standard "bog off" letter today, so things are progressing according to plan here

Hi there,
Over the past 5 years myself and my husband have been victims of massive bank charges totaling over £6600.00.
We have written to the complaints department at the bank in an attempt to reclaim these unfair charges. After several letters we were offered a refund of £500.00.This was totally unexceptable and we seeked advise from this web site and followed Martin's Tips. We took action by placeing a claim with moneyclaim on line and served a notice of issue to claim £5000.00.
The banks solicitor served (within the 14 days) a Acknowledgment of service which bought them another 14 days to file a defence.
We have now recieved a letter (26th day)from the banks solicitor, with a copy of a defence offering £2500.00 plus £120.00 court fees as a final refund.
Can you please advise us what to do from hear, do we except this offer or do we go on to the next step by filling in an allocation questionaire ?0 -

I'm just working out my wife's charges for the past year when she has gone over her overdraft limit
Lloyds TSB do put on their website that they will charge 30 quid if this happens. Does that mean they have covered themselves or do we still have a claim? 30 quid for a £9 error seems steep0
